This book was released on 1987 with total page 36 pages. Available in PDF, EPUB and Kindle.

Download or read book International Migration Law written by Vincent Chetail and published by Oxford University Press. This book was released on 2019-03-29 with total page 478 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Migration Law provides a detailed and comprehensive overview of the international legal framework applicable to the movement of persons across borders. The role of international law in this field is complex, and often ambiguous: there is no single source for the international law governing migration. The current framework is scattered throughout a wide array of rules belonging to numerous fields of international law, including refugee law, human rights law, humanitarian law, labour law, trade law, maritime law, criminal law, and consular law. This textbook therefore cuts through this complexity by clearly demonstrating what the current international law is, and assessing how it operates. The book offers a unique and comprehensive mapping of this growing field of international law. It brings together and critically analyses the disparate conventional, customary, and soft law on a broad variety of issues, such as irregular migration, human trafficking, refugee protection, labour migration, non-discrimination, regional free movement schemes, and global migration governance. It also offers a particular focus on important groups of migrants, namely migrant workers, refugees, and smuggled migrants. It maps the current status of the law governing their movement, providing a thorough critical analysis of the various stands of international law which apply to them, suggesting how the law may continue to develop in the future. This book provides the perfect introduction to all aspects of migration and international law.

Available in PDF, EPUB and Kindle. Book excerpt: The number of non-state actors, in the past not accountable for committing international crimes or violating human rights, is proliferating rapidly. Their ways of operating evolve, with some groups being increasingly fragmented and others organizing transnationally or in cyber space. As non-state armed groups are involved in the vast majority of today's armed conflicts and crisis situations, a new and increasingly important question has to be raised as to whether, and at what point, these groups are bound by international law and thereby accountable for their acts. Breaking new ground in addressing international human rights law, international criminal law, and international humanitarian law in one swoop, Rodenh user's text will be essential to academics and practitioners alike.

Book Law and Morality at War

    Book Details:
  • Author : Adil Ahmad Haque
  • Publisher : Oxford University Press
  • Release : 2017
  • ISBN : 0199687390
  • Pages : 305 pages

Download or read book Law and Morality at War written by Adil Ahmad Haque and published by Oxford University Press. This book was released on 2017 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: The laws are not silent in war, but what should they say? What is the moral function of the law of armed conflict? Should the law protect civilians who do not fight but help those who do? Should the law protect soldiers who perform non-combat functions or who may be safely captured? How certain should a soldier be that an individual is a combatant rather than a civilian before using lethal force? What risks should soldiers take on themselves to avoid harming civilians? When do inaccurate weapons become unlawfully indiscriminate? When does "collateral damage" to civilians become unlawfully disproportionate? Should civilians lose their legal rights by serving, voluntarily or involuntarily, as human shields? Finally, when should killing civilians constitute a war crime? These are the questions that Law and Morality at War answers, contributing to a cutting-edge international debate. Drawing on the concepts and methods of contemporary moral and legal philosophy, the book develops a normative framework within which the laws of war and international criminal law can be evaluated, criticized, and reformed. While several philosophical works critically examine the moral status of civilians and combatants, this book fills a gap, offering both an account of the laws of war and war crimes, and proposing how the law could be improved from a moral point of view. Finally, it explores when, if ever, the emotional pressures under which soldiers act should partially or wholly excuse their wrongful actions.

Book Taming Ares War Interstate Law and Humanitarian Discourse in Classical Greece

Download or read book Taming Ares War Interstate Law and Humanitarian Discourse in Classical Greece written by Emiliano J. Buis and published by BRILL. This book was released on 2018-05-01 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Taming Ares Emiliano J. Buis examines the sources of classical Greece to challenge both the state-centeredness of mainstream international legal history and the omnipresence of war and excessive violence in ancient times. Making ample use of epigraphic as well as literary, rhetorical, and historiographical sources, the book offers the first widespread account of the narrative foundations of the (il)legality of warfare in the classical Hellenic world. In a clear yet sophisticated manner, Buis convincingly proves that the traditionally neglected study of the performance of ancient Greek poleis can contribute to a better historical understanding of those principles of international law underlying the practices and applicable rules on the use of force and the conduct of hostilities.

Book excerpt: Young people are transforming the global landscape. As the human population today is younger and more urban than ever before, prospects for achieving adulthood dwindle while urban migration soars. Devastated by genocide, hailed as a spectacular success, and critiqued for its human rights record, the Central African nation of Rwanda provides a compelling setting for grasping new challenges to the world's youth. Spotlighting failed masculinity, urban desperation, and forceful governance, Marc Sommers tells the dramatic story of young Rwandans who are “stuck,” striving against near-impossible odds to become adults. In Rwandan culture, female youth must wait, often in vain, for male youth to build a house before they can marry. Only then can male and female youth gain acceptance as adults. However, Rwanda's severe housing crisis means that most male youth are on a treadmill toward failure, unable to build their house yet having no choice but to try. What follows is too often tragic. Rural youth face a future as failed adults, while many who migrate to the capital fail to secure a stable life and turn fatalistic about contracting HIV/AIDS. Featuring insightful interviews with youth, adults, and government officials, Stuck tells the story of an ambitious, controlling government trying to govern an exceptionally young and poor population in a densely populated and rapidly urbanizing country. This pioneering book sheds new light on the struggle to come of age and suggests new pathways toward the attainment of security, development, and coexistence in Africa and beyond. Book Beckett in Black and Red

Download or read book Beckett in Black and Red written by Alan Warren Friedman and published by University Press of Kentucky. This book was released on 2014-07-15 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1934, Nancy Cunard published Negro: An Anthology, which brought together more than two hundred contributions, serving as a plea for racial justice, an exposé of black oppression, and a hymn to black achievement and endurance. The anthology stands as a virtual ethnography of 1930s racial, historic, artistic, political, and economic culture. Samuel Beckett, a close friend of the flamboyant and unconventional Cunard, translated nineteen of the contributions for Negro, constituting Beckett's largest single prose publication. Beckett traditionally has been viewed as an apolitical postmodernist rather than as a willing and major participant in Negro's racial, political, and aesthetic agenda. In Beckett in Black and Red, Friedman reevaluates Beckett's contribution to the project, reconciling the humanism of his life and work and valuing him as a man deeply engaged with the greatest public issues of his time. Cunard believed racial justice and equality could be achieved only through Communism, and thus "black" and "red" were inextricably linked in her vision. Beckett's contribution to Negro demonstrates his support for Cunard's interest in surrealism as well as her political causes, including international republicanism and anti-fascism. Only in recent years have Cunard's ideas begun to receive serious consideration. Beckett in Black and Red radically revalues Cunard and reconceives Beckett. His work in Negro shows a commitment to cultural and individual equality and worth that Beckett consistently demonstrated throughout his life, both in personal relationships and in his writing.
