Book Lawyer Regulation and the Movement Toward a Unified Bar in Kentucky

Download or read book Lawyer Regulation and the Movement Toward a Unified Bar in Kentucky written by Jane H. Herrick and published by CreateSpace. This book was released on 2013-10-18 with total page 42 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work (approx. 6500 words) provides a history of how the lawyers of Kentucky became a self-regulating profession. Beginning in the 1870s, the lawyers of Kentucky made efforts to organize themselves for the betterment of the legal profession in the Commonwealth. There was no state-wide system of disciplining lawyers, and handling wayward attorneys was up to the discretion of local judges and prosecutors. This work traces the beginnings of an embryonic, loosely-organized professional group through to bar unification, which empowered the Kentucky Supreme Court and the lawyers of the Commonwealth to regulate the profession. An abridged version of this article was previously published in Kentucky Bench & Bar in 2006.

Available in PDF, EPUB and Kindle. Book excerpt: The First Amendment rights of lawyers are ethereal. Most lawyers fail to realize that courts may deny them access to the First Amendment's protective shield in many regulatory and disciplinary contexts. Overall, attorneys cannot and should not assume that they can obtain First Amendment protection - especially when acting as an attorney in their role as an 'officer of the court'. Yet, it is precisely in the lawyering context - where attorneys engage in speech, association, and petitioning for the very purpose of securing client rights, invoking law, enabling the judicial power, and obtaining justice - that the need for First Amendment protection is the most acute. If regulators silence that voice, they silence justice. From overarching theory to specific real-world contexts, this illuminating book provides a critical resource for lawyers, judges, and scholars to understand the relationship between the First Amendment rights of lawyers and the integrity of the justice system.

Book Extraordinary Justice

Download or read book Extraordinary Justice written by Craig Etcheson and published by Columbia University Press. This book was released on 2019-11-19 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: In just a few short years, the Khmer Rouge presided over one of the twentieth century’s cruelest reigns of terror. Since its 1979 overthrow, there have been several attempts to hold the perpetrators accountable, from a People’s Revolutionary Tribunal shortly afterward through the early 2000s Extraordinary Chambers in the Courts of Cambodia, also known as the Khmer Rouge Tribunal. Extraordinary Justice offers a definitive account of the quest for justice in Cambodia that uses this history to develop a theoretical framework for understanding the interaction between law and politics in war crimes tribunals. Craig Etcheson, one of the world’s foremost experts on the Cambodian genocide and its aftermath, draws on decades of experience to trace the evolution of transitional justice in the country from the late 1970s to the present. He considers how war crimes tribunals come into existence, how they operate and unfold, and what happens in their wake. Etcheson argues that the concepts of legality that hold sway in such tribunals should be understood in terms of their orientation toward politics, both in the Khmer Rouge Tribunal and generally. A magisterial chronicle of the inner workings of postconflict justice, Extraordinary Justice challenges understandings of the relationship between politics and the law, with important implications for the future of attempts to seek accountability for crimes against humanity.
