Book excerpt: Law-related words and phrases abound in our everyday language, often without our being aware of their origins or their particular legal significance: boilerplate, jailbait, pound of flesh, rainmaker, the third degree. This insightful and entertaining book reveals the unknown stories behind familiar legal expressions that come from sources as diverse as Shakespeare, vaudeville, and Dr. Seuss. Separate entries for each expression follow no prescribed formula but instead focus on the most interesting, enlightening, and surprising aspects of the words and their evolution. Popular myths and misunderstandings are explored and exploded, and the entries are augmented with historical images and humorous sidebars. Lively and unexpected, Lawtalk will draw a diverse array of readers with its abundance of linguistic, legal, historical, and cultural information. Those readers should be forewarned: upon finishing one entry, there is an irresistible temptation to turn to another, and yet another.

In fact, the very first lawyer to ever pass the bar was Mediocritus, who went on to invent the billable hour. People make jokes about lawyers for the same reason that dogs lick themselves because they can. Lawyers are easy targets because everyone in America has at one time either a) hired a lawyer, b) hated a lawyer, or c) has been a lawyer. No matter what your affiliation with the legal profession is, you will enjoy this book. If you don't enjoy it, hey, sue us.

Book Doing Integrative Theology

Download or read book Doing Integrative Theology written by Myk Habets and published by Lulu.com. This book was released on 2016-02-09 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: The doing of theology comes in many different guises and styles. This volume is concerned with Integrative Theology, a discipline which serves participation in the mission of God. It is a practice of discernment by which we aim to be attentive to God in God's world, God's word, and God's work, so as to grow in our understanding of what God wants for and is doing in the world. We seek this knowledge so that we may align ourselves with God's desire in relation to specific realities and issues and serve what we discern to be God's purpose with wisdom and courage. When we do that, we are participating in the mission of God. By means of an explanation of Integrative Theology, its aims, goals, and methods, and then through a series of essays illustrating the results of such a theology, this volume serves as a textbook for doing Integrative Theology. Students and faculty alike will find in this volume a valuable resource for doing theology in the early twenty-first century.

Book Law s Quandary

    Book Details:
  • Author : Steven D. Smith
  • Publisher : Harvard University Press
  • Release : 2009-07-01
  • ISBN : 0674043820
  • Pages : 223 pages

Download or read book Law s Quandary written by Steven D. Smith and published by Harvard University Press. This book was released on 2009-07-01 with total page 223 pages. Available in PDF, EPUB and Kindle. Book excerpt: This lively book reassesses a century of jurisprudential thought from a fresh perspective, and points to a malaise that currently afflicts not only legal theory but law in general. Steven Smith argues that our legal vocabulary and methods of reasoning presuppose classical ontological commitments that were explicitly articulated by thinkers from Aquinas to Coke to Blackstone, and even by Joseph Story. But these commitments are out of sync with the world view that prevails today in academic and professional thinking. So our law-talk thus degenerates into "just words"--or a kind of nonsense. The diagnosis is similar to that offered by Holmes, the Legal Realists, and other critics over the past century, except that these critics assumed that the older ontological commitments were dead, or at least on their way to extinction; so their aim was to purge legal discourse of what they saw as an archaic and fading metaphysics. Smith's argument starts with essentially the same metaphysical predicament but moves in the opposite direction. Instead of avoiding or marginalizing the "ultimate questions," he argues that we need to face up to them and consider their implications for law.

Book Language in the Judicial Process

Download or read book Language in the Judicial Process written by Judith N. Levi and published by Springer Science & Business Media. This book was released on 2013-11-11 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal realism is a powerful jurisprudential tradition which urges attention to sodal conditions and predicts their influence in the legal process. The rela tively recent "sodal sdence in the law" phenomenon, in which sodal research is increasingly relied on to dedde court cases is a direct result of realistic jurisprudence, which accords much significance in law to empirical reports about sodal behavior. The empirical research used by courts has not, how ever, commonly dealt with language as an influential variable. This volume of essays, coedited by Judith N. Levi and Anne Graffam Walker, will likely change that situation. Language in the Judicial Process is a superb collection of original work which fits weIl into the realist tradition, and by focusing on language as a key variable, it establishes a new and provocative perspective on the legal process. The perspective it offers, and the data it presents, make this volume a valuable source of information both for judges and lawyers, who may be chiefly concemed with practice, and for legal scholars and sodal sdentists who do basic research about law.
