Download or read book Torts third edition written by Jonathan L. Zittrain and published by MIT Press. This book was released on 2022-03-15 with total page 594 pages. Available in PDF, EPUB and Kindle. Book excerpt: A law school casebook that maps the progression of the law of torts through the language and example of public judicial decisions in a range of cases. A tort is a wrong that a court is prepared to recognize, usually in the form of ordering the transfer of money (“damages”) from the wrongdoer to the wronged. The tort system offers recourse for people aggrieved and harmed by the actions of others. By filing a lawsuit, private citizens can demand the attention of alleged wrongdoers to account for what they’ve done—and of a judge and jury to weigh the claims and set terms of compensation. This book, which can be used as a primary text for a first-year law school torts course, maps the progression of the law of torts through the language and example of public judicial decisions in a range of cases. Taken together, these cases show differing approaches to the problems of defining legal harm and applying those definitions to a messy world. The cases range from alleged assault and battery by “The Schoolboy Kicker” (1891) to the liability of General Motors for “The Crumpling Toe Plate” (1993). Each case is an artifact of its time; students can compare the judges’ societal perceptions and moral compasses to those of the current era. This book is part of the Open Casebook series from Harvard Law School Library and MIT Press.

Book Principles of the Law of Damages Classic Reprint

Download or read book Principles of the Law of Damages Classic Reprint written by Hugh Evander Willis and published by Forgotten Books. This book was released on 2017-10-16 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Law of Damages The general purpose of this new book on the law of Damages is like the purpose of the book on the law of Contracts by the same author, to give a complete treatise on the subject in a small volume. All the fundamental principles of the law of Damages are summarized in rules, or propositions of'law. Explanations are given for these propositions of law, with reasons therefor, together with criticisms thereof, whenever in the judgment of the author the rules are the subject of criticism. In order to further elucidate the propositions, copious illustrations are given, showing the application of the same. Under such a plan it is hoped that anyone reading the book will obtain a thorough understanding of the law of Damages. For the convenience of the reader the propositions of law, explanations and illustrations, are printed in different type. The illustrations used are founded upon the cases selected by Professor Beale and by Professor Mechem for their case books on Damages and upon such other cases as the author has deemed it expedient to incorporate in the vdume. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook on the Law of Damages The author's object in the present work, tin preparation of which has occupied a large portion of his time and attention for a period of nearly two years, has been to state, explain, and illustrate with elementary clearness and accuracy all the rules and principles governing the award of damages in civil cases. In view of the limitations of space in a one-volume work, it has been thought best to give the greater prominence to the discussion of the gen oral principles underlying the whole subject, letting the application of those principles to special classes of cases fall into a subsidiary place. Another reason for this arrangement is that the book is intended as much for the use of students as of practitioners. and for that purpose it is absolutely essential that the general and controlling principles of the subject should be fully and clearly explained. These are few, and are easily grasped when explained in logical and connected order; but when presented with a mass of details applicable only to the special case under discussion the difficulties of the subject are largely increased. Much confusion has also been caused by the loose and unscientific use of terms both by law writers and in judicial opinions. This is notably true with regard to nominal damages. That subject has been made almost unintelligible by the lack of consistency and precision in the use of the terms "wrong" and "damage." The notions embraced in these words have been very carefully analyzed in the first chapter. The fundamental nature of legal rights and wrongs has been looked at from a new point of view; and while no new theories are advanced, it is hoped that the subject has been made clearer.
