Book excerpt: Excerpt from Law of Assignments of Life Policies Few questions relating to insurance have involved Wider differ ences of judicial opinion than those regarding the assignment of life policies. In many, especially of the earlier cases, the true char acter of the life insurance contract has not been fully comprehended while the general doctrine of assignments, except in case of insol vency, notwithstanding its importance, seems to have received com paratively little attention at the hands of text writers. As a natu ral consequence, the legal principles which should control the trans fer of such contracts have been differently interpreted. Recent de cisions, which have not heretofore found their way into any of the ordinary text books, have thrown a flood of additional light on this subject. The value of a life policy largely depends upon the power of transfer. The want of a work for the bench, the bar, and those engaged in the business of life insurance, in which the decisions on this subject are analyzed, compared, and, if possible, harmonized, has been the motive for the preparation of the present volume. The aim has been to give special prominence to the most recent rulings, and to indicate, in so far as it can be done without usurping the functions of the courts, those views which have received the best ju dicial support.
