Book Law and Order in a Weak State

Download or read book Law and Order in a Weak State written by Sinclair Dinnen and published by University of Hawaii Press. This book was released on 2000-11-01 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twenty-five years after independence, Papua New Guinea is beset by social, economic, and political problems: poverty and inequality, a young and expanding population, a stagnant economy, corruption, and rising crime. The state has not only failed to contain these problems but has become progressively implicated in their persistence. Escalating levels of violence and lawlessness are seen by many as the most serious challenge facing the young country. This book examines these problems of order in light of Papua New Guinea’s remarkable social diversity and the impact of rapid and pervasive processes of change. Three original and strategic case studies involving urban gangs, mining security, and election violence form the core of the work. Each case study looks at particular forms of conflict, and the responses these engender, across different socioeconomic contexts and geographic locations. Empirical data are analyzed through a common framework that employs material, cultural and institutional perspectives, allowing readers to view the three cases through different theoretical prisms, identify linkages between them, and, in the process, build a larger picture of the post-colonial social order. Law and Order in a Weak State charts not only the problems of crime and lawlessness in Papua New Guinea but also the possibilities for constructive, pragmatic solutions. It will be of great interest to scholars, aid and policy officials, and others concerned with understanding the social complexities and challenges of contemporary Papua New Guinea.

Book Passage of Change

Download or read book Passage of Change written by Anita Jowitt and published by ANU E Press. This book was released on 2010-11-01 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Numerous issues face Pacific states trying to find their way in the early 21st century. Countries are striving to secure the benefits of modernisation. Governance, law and order are needed to reach such a goal, but development cannot be at the price of culture or the environment. The question of how to develop and maintain sound legal systems and legal rules whilst maintaining the unique cultural heritages within the Pacific is a challenge with no easy answer. This interdisciplinary collection locates issues of law and governance within the particular socio-political context of the Pacific island region, presenting sociological, anthropological and political insights alongside jurisprudential analysis. Key issues including corruption, the role of customary law in modern legal systems, the place of human rights in the Pacific, environmental issues and the structure of the state are explored from a variety of perspectives.

Book Law and Social Change in Postwar Japan

Download or read book Law and Social Change in Postwar Japan written by Frank K. Upham and published by Harvard University Press. This book was released on 2009-06-01 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many people believe that conflict in the well-disciplined Japanese society is so rare that the Japanese legal system is of minor importance. Frank Upham shows conclusively that this view is mistaken and demonstrates that the law is extensively used, on the one hand, by aggrieved groups to articulate their troubles and mobilize political support and, on the other, by the government to channel and manage conflict after it has arisen. This is the first Western book to take law seriously as an integral part of the dynamics of Japanese business and society, and to show how an informal legal system can work in a complex industrial democracy. Upham does this by focusing on four recent controversies with broad social implications: first, how Japan dealt with the world's worst industrial pollution and eventually became a model for Western environmental reforms; second, how the police and courts have allowed one Japanese outcast group to use carefully orchestrated physical coercion to achieve wide-ranging affirmative action programs; third, how Japanese working women used the courts to force employers to eliminate many forms of discrimination and eventually convinced the government to pass an equal employment opportunity act; and, finally, how the Ministry of International Trade and Industry and various sectors of Japanese industry have used legal doctrine to cope with the dramatic changes in Japan's economy over the last twenty-five years. Readers interested in the interaction of law and society generally; those interested in contemporary Japanese sociology, politics, and anthropology; and American lawyers, businessmen, and government officials who want to understand how law works in Japan will all need this unusual new book.

Book Policy Making and Implementation

Download or read book Policy Making and Implementation written by Ronald James May and published by ANU E Press. This book was released on 2009-09-01 with total page 413 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is a vast literature on the principles of public administration and good governance, and no shortage of theoreticians, practitioners and donors eager to push for public sector reform, especially in less-developed countries. Papua New Guinea has had its share of public sector reforms, frequently under the influence of multinational agencies and aid donors. Yet there seems to be a general consensus, both within and outside Papua New Guinea, that policy making and implementation have fallen short of expectations, that there has been a failure to achieve 'good governance'. This volume, which brings together a number of Papua New Guinean and Australian-based scholars and practitioners with deep familiarity of policy making in Papua New Guinea, examines the record of policy making and implementation in Papua New Guinea since independence. It reviews the history of public sector reform in Papua New Guinea, and provides case studies of policy making and implementation in a number of areas, including the economy, agriculture, mineral development, health, education, lands, environment, forestry, decentralization, law and order, defence, women and foreign affairs, privatization, and AIDS. Policy is continuously evolving, but this study documents the processes of policy making and implementation over a number of years, with the hope that a better understanding of past successes and failures will contribute to improved governance in the future.

Book Lo Bilong Yumi Yet

Download or read book Lo Bilong Yumi Yet written by Bernard Narokobi and published by [email protected]. This book was released on 1989 with total page 184 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book adds to the growing number of books by Melanesians on their region, and draws on the author's personal knowledge and experience of events that have shaped Melanesia. It is about the state of law in Papua New Guinea, and goes beyond custom to look at contemporary institutions. Custom continues to be prominent in village conflict resolution and acts like a "two-edged sword", moderating the rapidity of change and, at the same time, acting as a catalyst for change. Basic principles of English law are discussed and compared to the actual practices of law in Melanesia, and alternatives that would enable Melanesian countries to achieve a measure of harmony between classical and contemporary Melanesia are suggested."--Back cover
