Book Criminal Convictions in U S Tribal Law

Download or read book Criminal Convictions in U S Tribal Law written by Andrew Novak and published by Taylor & Francis. This book was released on 2024-08-02 with total page 183 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the first comparative law study of collateral consequences of criminal conviction in all federally recognized Indian tribes in the lower 48 U.S. states, and the mechanisms for restoring civil rights in tribal law. Surveying the constitutions, codes, and ordinances of tribal jurisdictions reveals a broad range of consequences – the impact of which has not been comprehensively and critically examined. Like state and federal jurisdictions, tribal law attaches thousands of legal disabilities to tribal offices, business licenses and permits, social services, and civil rights for persons with criminal convictions. This is especially true in economically important industries such as gaming and resource extraction; additionally, rapidly changing areas such as marijuana regulation and sex offender registries expand the scope still further. This book catalogues restoration of rights procedures in tribal law, to include pardons, expungements, and record sealing. Collateral consequences have proliferated in tribal law because of the limitations of tribal criminal jurisdiction, including over non-tribal members. However, tribal collateral consequences risk contributing to overcriminalization and social exclusion for persons with previous criminal convictions, especially as Native Americans are already disproportionately impacted by the U.S. criminal justice system. This book will appeal to legal academics, scholars, and practitioners working in tribal criminal law, as well as to others with interests in Indigenous legal issues.

Book Readings In American Indian Law

Download or read book Readings In American Indian Law written by Jo Carrillo and published by Temple University Press. This book was released on 1998 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: This selection of works -- many by Native American scholars -- introduces selected topics in federal Indian law. Readings in American Indian Law covers contemporary issues of identity and tribal recognition; reparations for historic harms; the valuation of land in land claims; the return to tribal owners of human remains, sacred items, and cultural property; tribal governance and issues of gender, democracy informed by cultural awareness, and religious freedom. Courses in federal Indian law are often aimed at understanding rules, not cultural conflicts. This book expands doctrinal discussions into understandings of culture, strategy, history, identity, and hopes for the future. Contributions from law, history, anthropology, ethnohistory, biography, sociology, socio-legal studies, and fiction offer an array of alternative paradigms as strong antidotes to our usual conceptions of federal Indian law. Each selection reveals an aspect of how federal Indian law is made, interpreted, implemented, or experienced. Throughout, the book centers on the ever present and contentious issue of identity. At the point where identity and law intersect lies an important new way to contextualize the legal concerns of Native Americans.

Book A People s Dream

Download or read book A People s Dream written by Dan Russell and published by UBC Press. This book was released on 2011-11-01 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this provocative and passionate book, Dan Russell outlines the history of Aboriginal self-government in Canada. He compares it to that of the United States, where, for over 150 years, tribes have practised self-government -- domestic dependent nationhood. Russell provides specific examples of how those institutions of government operate, and eloquently explains, from an Aboriginal perspective, what his people hope to achieve through self-governing authority. After describing rights theory, Russell locates Aboriginal self-government as a cultural right, and illustrates how the entitlements of Aboriginal women, an Aboriginal ethic, and collective rights, which are protected by self-governance, may conflict with the Canadian Charter of Rights.
