In Mexico these notions represented contested areas of the social terrain, places where generalized ideas about criminality transcended the individual criminal act to intersect with larger issues of class, race, gender, and sexuality. It was at this intersection that modern Mexican society bared its soul. Attitudes toward race amalgamation and indios, lower-class lifestyles and läperos, women and sexual deviance, all influenced perceptions of criminality and ultimately determined the fundamental issue of citizenship: who belonged and who did not. The liberal discourse of toleration and human rights, the positivist discourse of order and progress, the revolutionary discourse of social justice and integration sought in turn to disguise the exclusions of modern Mexican society behind a veil of criminality?to proscribe as criminal those activities that criminologists, penologists, and anthropologists clearly linked to marginalized social groups. This book attempts to lift that veil and to gaze, like Josä Guadalupe Posada, at the grinning calavera that it shields.

Book excerpt: Exploring the expansion of the penal system in Spain during the first 40 years of democracy, this book puts forward the importance of studying punishment from a sociological perspective and examines the neoliberal penality thesis. Today, Spain has more police officers and more people in prison than 50 years ago and a tougher penal code than that which existed at Franco’s death; however, crime has not increased for three decades, while most of the hardening of the penal system has occurred after its stabilisation. Studying the development of penality in Spanish democracy, this book explores Loïc Wacquant’s proposal that the expansion of the penal system should be understood as a characteristic of neoliberalism. It examines the parallel and reciprocal development of three policies in relation to the gradual implementation of neoliberal ideas and highlights how the evolution of the labour market, social policies, and the penal system are linked to one another and to neoliberal ideas related to the sacralisation of the utilitarian individual and the role of the state. Book excerpt: Contributing to the literature on comparative criminal procedure and Latin American law, this book examines the effects of adversarial criminal justice reforms on victim’s rights by specifically analyzing the Colombian criminal justice reform of the early 2000s. This research focuses on the production, interpretation, and implementation of rules and institutions by exploring how different actors have employed the concept of victims and victims’ rights to promote their agendas in the context of criminal justice reforms. It also analyzes how the goals of these agendas have interplayed in practice. By the early 2000s, it seemed that the Colombian criminal justice system was headed towards a process characterized by broader victim participation, primarily because of the doctrine of the Constitutional Court on victims’ rights. But in 2002, the Colombian Attorney General promoted a more adversarial criminal justice reform. This book argues that this reform represented a sudden and unpredicted reversal of the Constitutional Court’s doctrine on victim participation, even though one of the central justifications for the reform was the need to satisfy human rights standards and adhere to the jurisprudence of the Constitutional Court on victims’ rights. In the criminal justice reform of the early 2000s and its subsequent modifications, the promotion of a dichotomous interpretation of the adversarial model—which conceived the criminal process as a competition between prosecution and defense—served to limit victim participation. This study examines how conceptions of victims’ rights emerged out of the struggles between different and at times competing agendas. In the Colombian process of reform, victims’ rights have been invoked both as a justification for criminal sanctions and as an explanation for crime prevention and restorative justice. After assessing quantitative and qualitative data, this book concludes that punitive approaches to victims’ rights have prevailed over restorative justice perspectives. Furthermore, it argues that punitiveness in the criminal justice system has not resulted in more protection for victims. Ultimately, this research reveals that the adversarial criminal justice reform of the early 2000s has not substantially improved the protection of victims’ rights in Colombia.

Traditional criminal laws against sexual assault had a narrow scope: they targeted rape as coerced sexual intercourse, and they defined coercion as physical violence or threats with physical violence. Modern offense descriptions are tracing a change in the logic and structure of criminal laws against sexual assault from the offenders' violence to the victims' lack of consent as the key feature of criminal wrongdoing. However, there are clear and marked differences regarding the offence descriptions in substantive criminal laws in various jurisdictions. Sexual Assault: Law Reform in a Comparative Perspective provides an overview of the debates surrounding the concept and definition of sexual consent, comparing the context and content of law reform in six countries: Canada, England and Wales, Germany, Sweden, the U.S. (concentrating on the American Law Institute's Model Penal Code), and Spain. Leading scholars in the field also analyse the normative questions that arise once the notion of consent gains centre stage.
