Book excerpt: "This book discusses the links between land access, property rights, and economic development, analyzing the results and limitations of a public intervention- Land Titling and Registration- that constitutes one of the main instruments for contemporary land policy in Peru. It attempts to provide a comprehensive analysis and discussion of the importance of institutions, like land property rights, in the context of market liberalization reforms. In operational terms, this means verifying whether land titling constitutes a necessary and/or sufficient condition to promote investments and increase land values. This book reveals that titling and registration can be considered as a necessary condition to improve investment opportunities when its implementation procedure is based on the recognition of previous informal land rights and community networks, because its effect on the reduction of transaction costs at a regional level improves the dynamics of land markets and facilitates the entrance of formal financial institutions. A decentralized program is more likely to understand and correctly assess local conditions, as well as to concentrate its work on poorer farmers confronting stronger limitations to acquire tenure security by other means. Targeting must be applied also at the regional level, identifying less-developed areas that can benefit from the externality effects provided by increased levels of titling density. The presence of other limitations that constrain the participation of small farmers in the formal credit market, and the inability of titling to solve them by itself, makes it difficult to consider this policy as a sufficient condition to improve the livelihood of poorer farmers. Complementary policies that provide small farmers with the opportunity to increase their land-holdings, as well as the possibility to acquire insurance against negative shocks, need urgent implementation."

This book provides a critical analysis of the widespread assumption that the formalisation and standardisation of property rights through state legislation has a positive impact on economic development. It is based on anthropological case studies of land and natural resource rights in Southeast Asia and Oceania. These suggest that the economic impact of the formalisation of property rights is not necessarily positive, certainly not for all categories of peoples. They also suggest that state reform of property rights do not necessarily eliminate the conditions of legal pluralism, but rather add new legal structures to an already complex constellation of property rights and duties. The point of departure for the empirical analyses of the central hypothesis examined in this book is that the practical significance of complex forms of property rights and related socio-economic practices cannot be usefully examined within formalistic, one-dimensional and normatively oriented legalistic or economic approaches. Instead, an anthropoligical approach to law is advocated in order to analyse the complicated, multi-dimensional relationships between property rights and economic development, and their embeddedness in social practice. Based on this approach, the contributions to this book show how different people and institutions attribute different meanings to the various components of property relationships, and how they use them as resources in their everyday lives and social struggles.

Book excerpt: Free trade, free markets, and international investment are the paths to prosperity, but despite widespread adoption of these staples of the Washington Consensus more than 1.2 billion people still live on less than $1 per day. The search for determining the missing factor beyond these orthodox remedies for relieving poverty has led some to conclude that it is the growth of local capital markets built on robust, formalized property rights regimes that has led to uneven rates of economic development. This paper offers a critique of this hypothesis put forward in the property rights formalization literature, in particular Hernando de Soto's work The Mystery of Capital that sparked popular interest in the field. De Soto generally has one big idea per book. In The Other Path, he argued that the reason that informal economies existed was the large degree of bureaucracy in developing countries that forced small businesses to stay unregistered, and caused land to be untitled. The big idea behind The Mystery of Capital is that formalized, state-sanctioned property rights generate capital and promote economic development, as seen in the relative success of the legal systems of developed countries that have formalized their informal economies. This formalization allowed property to generate capital and grow developed economies. The explicit argument then is; if it worked for the West, it will work for the rest. In essence, De Soto and his compatriots argue that “This [formalized property] is the mystery of capital. Solving it requires an understanding of why Westerners, by representing assets with titles, are able to see and draw out capital from them.” Formalizing property rights is a popular idea. Endorsements range from Ronald Coase, Milton Friedman, Francis Fukayama, Jeanne Kirkpatrick, to David Owen, and Margaret Thatcher. Bill Clinton publicly declared that de Soto was “probably the world's most important living economist” for his work on property rights formalization. Even the World Bank now largely agrees with de Soto's analysis, stating that “[l]and is a key asset for the rural and urban poor.” The goal of this paper is to determine whether such widespread praise for property rights formalization is justified based on an analysis of the available empirical literature on the subject. Particular attention will be paid to the importance of considering the various derivations of property rights in culturally relative terms. The paper is structured as follows. Part I offers a general introduction to the property rights formalization literature, along with de Soto's thesis and primary claims. Part II critiques de Soto's methodology and data. Part III compares de Soto's results with those of other empirical studies measuring the efficacy of property rights formalization. Part IV focuses on how these lessons have been applied using a case study from Indonesia and examples from South Africa. Finally, Part V summarizes the promise and perils of property rights formalization. In conclusion, property rights formalization does hold the promise of unlocking capital and spurring economic development, but reform must be both comprehensive and culturally relative considering the unique cultural, social, and political heritage of the societies in question.

Illustrated with global case studies from Europe, Asia, Africa and Latin America, key sections explore land and rights to land, property, land tenure and reform, and land registration. Beginning by discussing the need to demarcate space by creating 'invisible lines' - which give certainty to what extent authority over land can be established - the book then explores legal and theoretical definitions of 'land' and 'property' and looks at the various different policies and forms of land tenure. One of the most recent developments in land reform policy has been to look to traditional forms of access to land and of resource conservation. The book argues that, while such policies on land property rights have great potential, they are best being adopted in a long-term, incremental way. It also shows how land policy reforms must be embedded in institutional and general policy reforms, complemented by rural development and educational opportunities for beneficiaries. The book summarises the main principles of land reform activities and practices and argues that the perception of land tenure security is the most critical factor of success to land reform.

Modern growth theory links the rise in the standard of living to capital formation, both physical and human, and to technological progress, and development economists continue to believe that the transformation of the less developed world cannot occur without massive government control of the economy. Scully, on the other hand, maintains that material advancement is as much affected by the choice of the economic, legal, and political institutions under which people live and work as it is by resource endowment and technological progress. Nothing in the neoclassical theory of growth considers the "rules of the game" under which capital is accumulated and innovation is made. Redressing this neglect, Scully proposes ways of measuring the economic, civil, and political freedom within a society's institutional framework, and he reveals that freedom, or the lack thereof, powerfully and demonstrably influences not only economic progress but also income distribution. Politically open societies grow at nearly three times the rate of those where freedom is more circumscribed, and they also have a more equitable distribution of income. Finally, Scully measures the effect of the size of the state on economic progress, showing that the larger the amount of government expenditures out of gross domestic product, the lower the rate of economic progress. Book excerpt: Increased global demand for land posits the need for well-designed country-level land policies to protect long-held rights, facilitate land access and address any constraints that land policy may pose for broader growth. While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.
