Available in PDF, EPUB and Kindle. Book excerpt: In Lands, Laws, and Gods, Daniel Gargola examines the formulation and implementation of laws regulating the use of public lands, including the establishment of colonies, in Republican Rome (509-27 B.C.). During this period of territorial expansion, the Romans developed the basic legal forms by which they governed captured land, and they constructed the processes and ceremonies by which those forms were translated into practice. Using agrarian law as a case study and focusing especially on rituals that both validated and gave structure to the administrative process, Gargola demonstrates the fundamental connections between religion, law, and government. Essential acts in the administration of agrarian legislation, such as the transfer of land from one party to another and the granting of contracts for public works, depended upon ritual formulas and gestures, often within the context of religious ceremonies. By recovering these formulas and their larger significance, Gargola reconstructs an important dimension of Roman life. Originally published in 1995. Book Zoning Rules

Download or read book Zoning Rules written by William A. Fischel and published by . This book was released on 2015 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Zoning has for a century enabled cities to chart their own course. It is a useful and popular institution, enabling homeowners to protect their main investment and provide safe neighborhoods. As home values have soared in recent years, however, this protection has accelerated to the degree that new housing development has become unreasonably difficult and costly. The widespread Not In My Backyard (NIMBY) syndrome is driven by voters’ excessive concern about their home values and creates barriers to growth that reach beyond individual communities. The barriers contribute to suburban sprawl, entrench income and racial segregation, retard regional immigration to the most productive cities, add to national wealth inequality, and slow the growth of the American economy. Some state, federal, and judicial interventions to control local zoning have done more harm than good. More effective approaches would moderate voters’ demand for local-land use regulation—by, for example, curtailing federal tax subsidies to owner-occupied housing"--Publisher's description.

Book excerpt: As the settler state of Canada expanded into Indigenous lands, two traditions clashed in a bruising series of asymmetrical encounters over land use and ownership. One site of conflict was Kahnawà:ke. The Laws and the Land delineates the establishment of a settler colonial relationship from early contact ways of sharing land; land practices under Kahnawà:ke law; and ultimately the Canadian invasion in the guise of the Indian Act, private property, and coercive pressure to assimilate. This meticulously researched book is connected to larger issues of human relations with environments, communal and individual ways of relating to land, legal pluralism, historical racism and inequality, and Indigenous resurgence.

Book Georgia Land Surveying History and Law

Download or read book Georgia Land Surveying History and Law written by Farris W. Cadle and published by University of Georgia Press. This book was released on 1991 with total page 597 pages. Available in PDF, EPUB and Kindle. Book excerpt: Georgia Land Surveying History and Law is the first definitive history and analysis of Georgia’s land system and the laws that govern it. The book’s opening section tells the story of the surveyor’s role in transforming Georgia from a frontier to a bounded, populated, and productive colony and state. Paced by anecdotes of surveyors’ wilderness experiences, the narrative traces the evolution of Georgia’s land subdivision system, beginning with the original, and ultimately impractical, scheme of land granting and rectangular land subdivision under the Trustees of the Georgia Colony. The volume then covers the more flexible but easily abused headright procedure, and the subsequent lottery and succession of systematic, rectangular surveys under which most of the state was laid out and granted in the early nineteenth century. Finally, in lay terms supported by meticulous citation of authority, the volume discusses the legal aspects of land surveying, including the interests that make up land ownership, the transfer of real property, the interpretation of property descriptions, the location of boundaries, riparian and littoral rights, and other topics. The book examines every point concerning boundaries found in any Georgia case or statute. Based solidly on primary sources and the author’s fifteen years of experience in land surveying and title abstracting, Georgia Land Surveying History and Law is an exhaustively researched and scholarly reference that will be useful to surveyors, title attorneys, title abstractors, real estate professionals, geographers, cartographers, historians, and genealogists.
