Book excerpt: This book provides the first systematic and comprehensive analysis of the factors that explain both completed and incomplete treaty negotiations between Aboriginal groups and the federal, provincial, and territorial governments of Canada. Since 1973, groups that have never signed treaties with the Crown have been invited to negotiate what the government calls “comprehensive land claims agreements,” otherwise known as modern treaties, which formally transfer jurisdiction, ownership, and title over selected lands to Aboriginal signatories. Despite their importance, not all groups have completed such agreements – a situation that is problematic not only for governments but for Aboriginal groups interested in rebuilding their communities and economies. Using in-depth interviews with Indigenous, federal, provincial, and territorial officials, Christopher Alcantara compares the experiences of four Aboriginal groups: the Kwanlin Dün First Nation (with a completed treaty) and the Kaska Nations (with incomplete negotiations) in Yukon Territory, and the Inuit (completed) and Innu (incomplete) in Newfoundland and Labrador. Based on the experiences of these groups, Alcantara argues that scholars and policymakers need to pay greater attention to the institutional framework governing treaty negotiations and, most importantly, to the active role that Aboriginal groups play in these processes.

Despite 35 years of negotiations, many Aboriginal groups have failed to complete modern treaties. This dissertation explains why some Aboriginal groups have been able to complete modern treaties and why some have not. After examining four sets of negotiations in Newfoundland and Labrador and the Yukon Territory, I argue that scholars need to pay greater attention to the institutional framework governing treaty negotiations and to a number of factors relative to the Aboriginal groups.

Book excerpt: In the early 1990s, when a process was established to negotiate modern-day treaties in British Columbia (BC), it was presumed that a majority of First Nation land claims would be resolved over the course of the following twelve years. Now, some fifteen years later, only two agreements have been reached as a part of this process. The reasons for this malaise are many, and while the relative failure of the treaty process in BC could be attributed to any number of factors, this thesis examines the inception of this process, with a focus on the period 1995-99, as a basis for challenging the perception that we have transcended the policy of denial that characterized indigenous-state relations in BC prior to the treaty process. Relying upon participant-observation, ethnographic interviews, and an analysis of media, this thesis asks: how has the discursive context of the BC land question been transformed by the treaty process? What impact did the perception that the public was being called upon to participate in forums about the BC land question have on the discursive construction of this policy field? And how did the perception that BC had entered a new era of recognition (rather than of denial) inform peoples' sense of what the treaty process was about and the outcomes it would lead to? The thesis argues that the historical policy of denial that characterized indigenous-state relations in BC continues to be embodied in a dialectic of validation and constraint that informs contemporary efforts to manage the BC land question. It is by advancing this analysis that this thesis seeks not only to bring an element of clarity to a process that continues to frustrate the aspirations of many First Nations in BC, but also highlights some of the contributions that anthropology has to make to a study of public policy.

The first, a discourse of justice, asks how we can remedy the past injustices imposed on BC First Nations. The second, a discourse of certainty, asks whether historical repair can occur in a manner that provides a better future for all British Columbians. Andrew Woolford examines the interplay between Aboriginal and non-Aboriginal visions of justice and certainty to determine whether there is a space between the two concepts in which modern treaties can be made. He suggests that greater attention to justice is necessary if we are to initiate a process of reconciliation.
