Download or read book Law Equity written by and published by Martinus Nijhoff Publishers. This book was released on 2013-10-31 with total page 229 pages. Available in PDF, EPUB and Kindle. Book excerpt: Quite by accident, Roman law and English law share a peculiar dual structure. In both systems, the law (ius civile, Common law) was supported, amended and corrected by a second legal source (ius honorarium, Equity) found in the jurisdiction of particular magistrates. How did this dual structure come into being in Rome and England, and how did it influence legal developments? In Law & Equity: Approaches in Roman law and Common law, seven specialists explore the origins and consequences of this interaction. The history of equity and law is treated by Willem Zwalve, Paul Brand, David Ibbetson and Mike Macnair, while John Cartwright, Hendrik Verhagen, Frits Brandsma and Willem Zwalve offer a comparative legal history on issues of substantive law.

Book Law and Politics in Jacobean England

Download or read book Law and Politics in Jacobean England written by Louis A. Knafla and published by Cambridge University Press. This book was released on 1977-09-22 with total page 392 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study is devoted chiefly to Ellesmere's career and writings as Lord Chancellor, 1603-1617. After an introduction to his life and career from 1541 to 1603, Part One is a study of his role in the legal and political history of Jacobean England. In order to place the analysis of law and politics in a broader context, topics discussed include economics, religion, social customs and thought, in addition to questions concerning the forms of action at common law, disputes between the courts, law and equity, and the political activities of Parliament, the Privy Council, and the Crown. Part Two consists of a critical edition of eight of Ellesmere's little known or unidentified tracts on the royal prerogative, Anglo-Scots Union, the Parliament of 1604-1610, the administration of government, law reform, the ecclesiastical courts, Coke's Law Reports and the Chancery-Common Law conflict.

Book British Identities before Nationalism

Download or read book British Identities before Nationalism written by Colin Kidd and published by Cambridge University Press. This book was released on 1999-03-13 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: Inspired by debates among political scientists over the strength and depth of the pre-modern roots of nationalism, this study attempts to gauge the status of ethnic identities in an era whose dominant loyalties and modes of political argument were confessional, institutional and juridical. Colin Kidd's point of departure is the widely shared orthodox belief that the whole world had been peopled by the offspring of Noah. In addition, Kidd probes inconsistencies in national myths of origin and ancient constitutional claims, and considers points of contact which existed in the early modern era between ethnic identities which are now viewed as antithetical, including those of Celts and Saxons. He also argues that Gothicism qualified the notorious Francophobia of eighteenth-century Britons. A wide-ranging example of the new British history, this study draws upon evidence from England, Scotland, Ireland and America, while remaining alert to European comparisons and influences.
