Book Groundwater Law and Management in India

Download or read book Groundwater Law and Management in India written by Sarfaraz Ahmed Khan and published by Springer Nature. This book was released on 2021-07-23 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a comprehensive analysis of the existing nature of India’s groundwater laws. In the backdrop of the gravity of groundwater crisis that threatens to engulf the country, the book examines the correlation between the imperfections in the law and water crisis and advocates a reform agenda to overhaul the legal framework. It accomplishes this objective by examining how some of the States and Union Territories regulate and manage groundwater through the legal instrumentality against the backdrop of the two conflicting paradigms: the “elitist” and the “egalitarian.” The book’s fundamental premise is that despite being an extraordinarily critical resource that supports India’s burgeoning population’s ever-increasing water demands, groundwater is abused and mismanaged. The key argument that it posits is that the elitist paradigm must give way to an egalitarian one where groundwater is treated as a common property resource. To place this message in perspective, the book’s introduction explains the dichotomy between the two paradigms in the context of groundwater. This sets the stage, after which the book is divided thematically into three parts. The first part deals with some of the general groundwater management concerns brought to the fore by the operation of the elitist paradigm. Since water is constitutionally a State subject, the second part analyses the groundwater legislations of different States and Union Territories set against their unique circumstances. As these laws do not dismantle the elitist paradigm that interlocks groundwater rights to land rights, the next part articulates the legal reform agenda where a case is made to re-engineer groundwater laws to reflect a more sustainable basis. The findings and arguments resonate with the situation in many developing countries around the world due to which the book is a valuable resource for researchers across disciplines studying this area, and also for policy makers, think tanks, and NGOs. Available in PDF, EPUB and Kindle. Book excerpt: Environmental law and policy in India affects all sections of society. Those most deeply affected by it are the poor. They are the first victims of poor sanitation, polluted air, and contaminated water. Since the 1970s, efforts to protect environmental quality have met with limited success, posing enduring challenges for policy designers and decision-makers entrusted with protecting and preserving natural resources. This edition of Environmental Law and Policy retains the familiar analytical structure of the second edition and includes all major developments since then. It focuses on Indian environmental law, policies, problems, and needs with the comprehensiveness of an American law case book, compiles all the leading cases in environmental law in India with concise extracts of landmark judgments and policy documents, and provides discussions on projects which could potentially degrade the environment. This volume also covers air and water pollution, forests, wildlife, noise pollution, common property resources and tribal communities, environmental impact assessment, coastal regulations, large projects, urban problems, the National Green Tribunal, hazardous substances, transnational environmental policies, and international environment law. It is interlaced with notes, comments, and questions intended to encourage critical thinking amongst lawyers and law students.

Download or read book A Land of One s Own written by Lata Marina Varghese and published by Cambridge Scholars Publishing. This book was released on 2015-02-05 with total page 95 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents an informative examination of how the issue of women’s land rights has been dealt with both in Indian literature, particularly Indian English fiction, and in Indian society. The human rights of women are a revolutionary notion that has opened the way for the definition, analysis, and articulation of women’s experiences of widespread violence, degradation, discrimination, and marginality. Globally, women’s land rights are becoming an area of increasing urgency and concern as discrimination against women over land, property and inheritance rights continues to keep them in a subordinate position even today. Land empowers, and equality in land rights is an indicator of women’s economic empowerment and at the same time helps in poverty reduction. Many Indian writers, especially Indian English women novelists, have dealt with issues of land, dispossession, hunger and poverty in rural India in particular, but none have explicitly referred to women’s land rights. For men, land is an essential element of their identity as ‘provider’, but for women it is a demand for recognition as a human being. However, women in India are rarely landowners, and in most Indian families women do not own any property in their own names. They are usually refused a share in the paternal property, although, according to the Indian Succession Act, 1925, everyone is entitled to equal inheritance. Unfortunately in India, law and society conspire to deny women their right to land ownership, although there have been several legal amendments to redress this gender inequality. This book deals with the gap that lies between women’s land rights in India and the actual ownership of land.
