Book excerpt: La naturaleza de este trabajo es realizar un estudio comparativo entre los Acuerdos firmados entre el Estado español y la Santa Sede en 1976 y 1979 y, los firmados entre el Estado español y las confesiones religiosas minoritarias en 1992, desde la perspectiva de los principios constitucionales. El trabajo se inicia con un análisis histórico de las relaciones entre el Estado y las confesiones religiosas que toman como punto de partida el constitucionalismo del siglos XIX y concluyen con la Constitución de 1978, norma fundamental que instaura como principios: el personalismo, la igualdad en la libertad, la libertad de conciencia, la participación, el pluralismo y tolerancia, la laicidad del Estado y la cooperación del Estado con las confesiones religiosas. La parte fundamental del trabajo se centra en el análisis de las relaciones Estado-fenómeno religioso desde la perspectiva de los principios de la Constitución de 1978 y su desarrollo en los Acuerdos de 1979 sobre Asuntos Jurídicos, sobre Enseñanza y Asuntos Culturales, sobre Asuntos Económicos y sobre Asistencia religiosa a las Fuerzas Armadas y servicio militar de clérigos y religiosos; y los Acuerdos de cooperación de 1992 entre el Estado español y la Federación de Entidades Religiosas Evangélicas de España, la Federación de Comunidades Israelitas y la Comisión Islámica de España.Para ello, en primer lugar, se analizan los precedentes de la actual situación de la libertad religiosa en España, con la ayuda del estudio de la doctrina sobre el tema. En segundo lugar, la cooperación establecida entre el Estado español y las Iglesias, Confesiones y Comunidades religiosas, así como el contenido de los Acuerdos. Y por último, se comparan dichos Acuerdos desde el contenido hasta el desarrollo, de manera que nos desvelen las similitudes y diferencias que propician la igualdad o desigualdad entre los creyentes.

Book excerpt: El campo de las relaciones político-sociales existentes entre el hecho político y el hecho religioso ha estado marcado, a lo largo de la historia, por un tono de manifiesta o latente problematicidad. Incluso en aquellas situaciones en las que el buen entendimiento podría parecer que prevalecía sobre el enfrentamiento conflictivo. Lo que no debe sorprendernos, ya que las diversas situaciones vividas en los diferentes momentos históricos pueden ser leídas, analizadas e interpretadas razonablemente desde la perspectiva del encuentro de intereses más o menos contrapuestos, buscados y defendidos desde posicionamientos y motivaciones diferentes. En todo caso, se trataría de realidades no meramente individuales, sino sociales o colectivas. El problema que se aborda en este estudio va más allá del ámbito de las relaciones entre el hecho político y la religiosidad y fe de los creyentes individuales. Un problema que entra en el campo de las connotaciones sociales, nacidas de la pertenencia de esos creyentes a grupos y colectivos dotados de una mayor o menor fuerza social y también política. La relación entre el hecho político y la religiosidad humana adquiere así unas características sociales y políticas propias, que pueden formularse en términos de relaciones entre la política y la religión, entre el hecho político y el hecho religioso. La intención de situar este tema en la concreción de las relaciones entre la Iglesia y el Estado, en el ámbito del Estado español, no debe inducirnos a pensar que esta problemática es de hoy, propia de la Iglesia católica y exclusiva del Estado español. Al contrario, es un problema recurrente a lo largo de la historia y de las diversas maneras de institucionalizar la vida de la comunidad religiosa y de entenderse a sí misma la comunidad política. Tampoco es exclusivo de la fe cristiana y de la Iglesia católica. Por eso no estará de más recordar que no es este un problema específicamente nuestro, sino que existe, también en nuestros días, en múltiples lugares del mundo, y que, de alguna manera, adquiere dimensiones universales Cabría hablar, por ello, en términos más generales, de las relaciones y de la problemática suscitada por la convivencia de los Estados o comunidades políticas con las comunidades o grupos religiosos, institucionalizados de diversas maneras en esos Estados. Dada su complejidad, hay que hablar de lo que se entiende que ha de ser la justa ordenación de las relaciones político-sociales entre los Estados y las religiones.
