Pensado y escrito al calor del debate sobre la politización del derecho, se convirtió inmediatamente en un punto de referencia obligada. Contra los partidarios del positivismo jurídico –la concepción de que la ley existe para ser aplicada, sin miramientos sobre la moralidad o justicia de su contenido, casi a modo de fórmulas matemáticas que deben manejar quienes realmente saben: los científicos del área, los jueces–, Nino defiende la tesis de que el derecho es un fenómeno esencialmente político y que es imposible, tanto como incorrecto, "leerlo" aislado. Cualquier Constitución moderna está comprometida con valores y principios (al hablar de "justicia" e "igualdad", forzosamente nos hace pensar en moral y política). ¿Qué significa, por ejemplo, "aplicar" las cláusulas constitucionales sobre libertad de expresión, ante un político que se considera violentado por las críticas que ha recibido? ¿Corresponde privilegiar la protección de su honor o el derecho de la comunidad democrática a un debate público lo más amplio posible? Casos que dan forma a la vida cotidiana del derecho –la violencia familiar, el aborto, la privacidad vulnerada– requieren ejercicios de reflexión teórica más abstracta, y nos invitan a pensar en valores, principios, teorías de la justicia, teorías de la democracia... Nino expone las diferentes concepciones sobre la práctica del derecho y discute productivamente con ellas. El derecho no puede ser reducido a un ejercicio de lógica cerrada ni confinado al estudio de los especialistas: demanda diálogos interpretativos más amplios e inclusivos, e involucra consideraciones inevitables en torno a la moralidad, la política y a los modos en que todas estas esferas se vinculan entre sí. Derecho, moral y política resulta, por todo esto, un libro fascinante.

Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law. The contributions gathered here examine how this challenge was met in political-legal practice, and the role of constitutional jurisdiction in the process.
