Book excerpt: The complex nature of industrial design, which combines functional and aesthetic elements, allows different modes of protection: cumulative, separate or partially overlapping regimes are applicable according to different legal systems. The legal framework is rapidly changing, especially in Europe where the principle of cumulation of a special sui generis regime for protecting industrial design with copyright rules has been established. In the last decade, national courts of some Member States conferred to the “cumulative regime” a peculiar meaning, other courts enforced design rights in line with the interpretation given by the Court of Justice of the EU. The copyright/design interface is presented here to a wider, non-specialist audience, taking as a starting point the notion of industrial design derived from design studies, on the border between art and science.

Oggetto dell’analisi è il software, ossia quella “creazione intellettuale” che in quanto tale per essere giuridicamente protetta dovrebbe essere sottoposta ad una tutela ben definita. L’obiettivo del presente testo è quello di comprendere, in un avvicendarsi di interferenze e convergenze, come agire e come proteggere il software in funzione della sua peculiare struttura costituita da due elementi, tecnologico (che ne definisce la sua applicazione pratica) e descrittivo (che ne definisce la sua forma espressiva), assumendo quindi un articolato dibattito sulla dicotomia diritto d’autore/brevetto rispetto al dualismo forma/contenuto: è possibile una “complementarietà” delle due tutele? Abbiamo assistito sino ad oggi ad un cambiamento della tecnologia e dell’utilizzo del software che ha comportato il passaggio graduale da una tecnologia analogica ad una tecnologia digitale, secondo diverse modalità di distribuzione delle opere dell’ingegno e diverse forme di controllo ed esecuzione. In seguito quindi allo sviluppo sempre crescente della tecnologia informatica (che comprende gli apparecchi digitali e i programmi software) e telematica (che si esprime nelle reti telematiche), il cui compito è di adempiere alla crescita della conoscenza e allo sviluppo delle capacità umane, la dottrina si è assunta l’incarico di studiare ed interpretare il tema del software, di Internet e della Rete. Le nuove tecnologie informatiche e di telecomunicazione costituiscono i due pilastri su cui si regge la cosiddetta Società dell’Informazione. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Book excerpt: The recent development of ideas on biodiversity conservation was already being considered almost three-quarters of a century ago for crop plants and the wild species related to them, by the Russian geneticist N.!. Vavilov. He was undoubtedly the first scientist to understand the impor tance for humankind of conserving for utilization the genetic diversity of our ancient crop plants and their wild relatives from their centres of diversity. His collections showed various traits of adaptation to environ mental extremes and biotypes of crop diseases and pests which were unknown to most plant breeders in the first quarter of the twentieth cen tury. Later, in the 1940s-1960s scientists began to realize that the pool of genetic diversity known to Vavilov and his colleagues was beginning to disappear. Through the replacement of the old, primitive and highly diverse land races by uniform modem varieties created by plant breed ers, the crop gene pool was being eroded. The genetic diversity of wild species was equally being threatened by human activities: over-exploita tion, habitat destruction or fragmentation, competition resulting from the introduction of alien species or varieties, changes and intensification of land use, environmental pollution and possible climate change.

Traditionally, restrictions to parallel trade were regarded negatively because they ran against the rules of the EU internal market. However, in recent judgments (Bayer, Glaxo, and Syfait), EU courts questioned some of the legal principles underpinning the EU policy on parallel trade in the field of pharmaceuticals. This shift suggested that there might be scope for improvement of such policy. However, how and to what extent this change should be performed remained partially unclear. Through the analysis of the impact that parallel trade of pharmaceuticals has on consumer welfare, both in a static and in a dynamic sense, this book examines whether the current legal approach to parallel trade of pharmaceuticals reflects the findings of economic theory, whether it should change, and, if so, on what basis this adjustment should take place. The analysis not only provides a policy assessment, but also offers some insights on one of the issues debated within the process of modernization of EU competition law: how judges should integrate economic reasoning in the antitrust assessment of corporate practices.
