Book excerpt: Cet ouvrage a tout d’abord permis de constater que le droit de l’énergie est un droit composite qui ne peut être dissocié des problématiques afférentes au droit de la concurrence. Dans ce cadre, la « transition énergétique » est ici définie comme le passage d’un système énergétique fondé principalement sur des énergies fossiles vers un bouquet énergétique reposant sur des sources énergétiques renouvelables. L’ouvrage traite essentiellement de la transition énergétique sous l’angle du droit économique. Dans cette perspective, une étude comparée des systèmes juridiques français et italien, au regard également des politiques publiques, a été proposée afin de mettre en exergue les alternatives éventuelles au modèle énergétique existant en France. Cette approche a permis de tracer les contours de deux modèles énergétiques différents et d’identifier les éléments nécessaires à une véritable mise en oeuvre de la transition énergétique. Par la prise en compte de l’exemple italien, une analyse prospective a été effectuée afin de préciser le chemin que la France pourrait faire et l’impact que cela pourrait avoir sur le marché de l’électricité. D’importantes différences ont été constatées au niveau des mécanismes d’incitations aux énergies renouvelables, des fondements constitutionnels de la décentralisation et du développement de la régulation du secteur électrique. L’impact de la transition énergétique sur le démantèlement des centrales nucléaires françaises a également été analysé. Cet ouvrage tend à démontrer qu’il n’existe pas de modèle idéal en matière de transition énergétique. Néanmoins, une mise en oeuvre efficace de la transition énergétique doit nécessairement prendre en compte les exemples des autres pays. Cet ouvrage a également permis de mettre à jour, au 1er novembre 2016, les textes et la jurisprudence dans une matière qui a été très mouvante durant ces dernières années. Par la richesse de ses sources comparées, il intéressera autant les professionnels et leurs conseils que les universitaires et les pouvoirs publics.

This national champion was shaken in 2008, when it was obliged to introduce ‘load shedding’, or rolling blackouts, and again in late 2014. Trying to understand how and why one of the iconic pillars of South African state capitalism is now in distress, the authors of this book argue that the so-called electricity crisis is in fact a public monopoly crisis. Moving beyond technical aspects, they explore the relationship between state power and Eskom before, during and after apartheid. From this perspective, they suggest that the current technical and financial troubles of this public utility are illustrative of the weakening of its technopolitical regime, of how national institutions have governed Eskom’s technological development, and of the pursuit of political goals in the production of electrical power. Without a clear industrial strategy during the 2000s, Eskom became a powerful tool of Broad-Black Economic Empowerment as well as a neopatrimonial system which generates profits captured by the ruling party. As a result, crisis in Eskom shakes the whole political edifice. Inefficient and its finances increasingly under scrutiny, this state-owned enterprise’s existence as a monopolistic public utility is regularly a subject of debate. The authors discuss the ambivalent role of Eskom in the national energy transition policy and whether solutions point in the direction of de-integrating this public monopoly and allowing its current technopolitical regime to enter a planned or natural decline.

What is the nature of social innovations? 2.What patterns can be identified in social innovations emerging at the local level? 3.How is the emergence and spread of social innovations related to urban governance? More precisely, which conditions and arrangements facilitate and hinders social innovation? We explore these questions using different types of data and methods, and studying different contexts. In particular, we focus on innovations that aim at solving problems of the young unemployed, single parents and migrants. This analysis is based on original research carried out in the period 2010-2013 in the framework of a European project with a specific empirical research strategy. These games convey ethical values and local identity. Roberte Hamayon bases her analysis of the playing spectrum on their scrutiny. Starting from fighting and dancing, encompassing learning, interaction, emotion and strategy, this study heads towards luck and belief as well as the ambiguity of the relation to fiction and reality. It closes by indicating two features of play: its margin and its metaphorical structure. Ultimately revealing its consistency and coherence, the author displays play as a modality of action of its own. "Playing is no 'doing' in the ordinary sense" once wrote Johan Huizinga.
