A pesar de las críticas de que ha sido objeto, analizar la obra de Kelsen en la actualidad resulta necesario para entender el funcionamiento del sistema jurídico y la estructura de la norma jurídica, pero también para comprender muchos campos relacionados con la teoría general del derecho, como la jerarquía normativa, la interpretación del derecho, el rol de los jueces constitucionales, la relevancia del derecho internacional y la esencia y el valor de la democracia

Pues el derecho es por su misma naturaleza un orden coactivo, o sea un orden social que prevé actos coactivos como sanciones a dirigirse a título de reacciones contra la conducta considerada indeseable por la autoridad social. Si ese orden social está relativamente centralizado, constituye la comunidad que llamamos Estado. Por lo tanto, una teoría del derecho completa implica necesariamente una teoría del Estado. Los dos estudios contenidos en este libro presentan un análisis crítico de las teorías marxistas del derecho y del Estado que prevalecen en la Unión Soviética. Allí, esas teorías sirven de ideología a una de las organizaciones más poderosas del mundo. Ello justifica, desde un punto de vista político, un examen cuidadoso. Sin embargo, mis estudios no han sido emprendidos desde ese punto de vista. Ellos intentan una crítica científica, es decir objetiva, que no involucra ningún juicio de valor moral o político en favor o en contra del sistema social comunista, el cual debe ser distinguido, como realidad social, de su ideología. Es lógico que toda crítica presuponga un valor; pero el valor presupuesto por una crítica científica no es un valor moral o político, sino lógico; el valor de verdad, no de justicia.
