Yet, corporations are not traditional objects of criminal law. Justified by notions of personal moral guilt, criminal norms have been judged inapplicable to fictional persons, who ‘think’ and ‘act’ through human beings. The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders. It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.

This is particularly true for the operational phase of the scheme that represents by far the longest period in its lifetime cycle. Bulletin 154 presented a general approach and concepts to be applied to dam operation. The current Bulletin 175 extends the developed concepts to all phases preceding the operational phase. Many risks associated with the operation of existing dams have their origins in other phases preceding the actual operation. Although there are numerous ICOLD Bulletins addressing technical aspects of planning, design, construction and commissioning of dams, there is not a single Bulletin which covers the subject in a comprehensive manner. The current document is a first attempt to capture all relevant dam safety aspects in all preoperational phases by systematically characterizing the actors involved, their roles, the activities and complex interactions present in different phases of the dam lifecycle. An Overarching Safety Management System is specifically developed that can be applied to all actors involved. La gestion de la sécurité des barrages est une préoccupation majeure pendant tout le cycle de vie d'un projet de barrage. Cela est particulièrement vrai pour la phase opérationnelle du système qui représente de loin la période la plus longue de son cycle de vie. Le Bulletin 154 présente une approche générale et des concepts à appliquer à l'exploitation des barrages. Le Bulletin 175 actuel étend les concepts développés à toutes les phases précédant la phase d'exploitation. De nombreux risques associés à l'exploitation des barrages existants ont leur origine dans d'autres phases précédant l'exploitation proprement dite. Bien qu'il existe de nombreux bulletins ICOLD traitant des aspects techniques de la planification, de la conception, de la construction et de la mise en service des barrages, il n'existe pas un seul bulletin qui couvre le sujet de manière exhaustive. Le document actuel est une première tentative de capturer tous les aspects pertinents de la sécurité des barrages dans toutes les phases pré-opérationnelles en caractérisant systématiquement les acteurs impliqués, leurs rôles, les activités et les interactions complexes présentes dans les différentes phases du cycle de vie du barrage. Un système global de gestion de la sécurité est spécifiquement développé et peut être appliqué à tous les acteurs impliqués.

As part of the Foundation’s multifaceted activities—which range from seminars and an advanced training initiative for French doctoral students to joint programs with international organizations an associations—FNEGE partnered with ISEOR to sponsor a series of workshops on developing high quality intervention-research. This volume is one of the results from that endeavor. Although intervention-research helps to uncover valuable insight into organizational dynamics and performance, the challenge of capturing and disseminating that insight to both academics and practitioners is entrenched in the rigor-relevance debate. While we are witnessing increased calls for “actionable knowledge,” this ideal, unfortunately, remains a rather elusive concept as critics contend either that rigorous academic research falls well-short of relevance to the practitioner world or research that proves to be valuable to practitioners falls short of the rigor expected in academic life. This volume is intended to help bridge that divide. Drawing on the FNEGE-ISEOR intervention-research workshop, the volume contains 18 chapters that explore the intervention-research process, from initial conceptualization, to implementation, to publication. Book excerpt: Within the framework of the European Commission's Falcone programme, a study of the organisation of the fight against corruption in the Member States and candidate countries of the European Union was established by Ghent University. The results of the study can be found in this book, which provides a comparative analysis of anti-corruption arrangements across 24 European States. In addition to this it includes the full texts as provided by the experts selected to contribute both to the volume itself and the accompanying two-day meeting in Ghent, Belgium. The collection and publication of these reports supports one of the two central aims of the project: to assist in furthering mutual knowledge and understanding of the legal frameworks and organisations that are tasked with the fight against corruption across the European Union and candidate countries. This collection also reflects the second central aim of the project which was to assist in the formation of a wide network of people involved in anti-corruption efforts. For this reason the provided texts have come from a broad spectrum of interested agencies and individuals. Subsequently, they provide a broader picture of corruption in the 24 countries than might otherwise be expected. Accordingly, this four part volume begins with a brief introduction in which the aims, context, methodology and questionnaire are covered. Part two provides a comparative analysis of the reports, bolstered by the findings of the meeting. Part three contains the collected reports and can be used by practitioners and others interested in the anti-corruption arrangements of the various European Union Member States and candidate countries. The fourth and final part of this volume is a concluding statement in which the recommendations of the final meeting are suggested for consideration.
