Book excerpt: The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.

Cette importante fonction authentificatrice lui impose en retour des devoirs professionnels particulièrement étendus, notamment une obligation de conseil protéiforme. Cet ouvrage embrasse les multiples aspects de la fonction notariale sous l'angle de la responsabilité et de l'accroissement des obligations professionnelles. Au " devoir de conseil " mis au point par la jurisprudence, se sont ajoutées de nombreuses obligations de vérification et de déclaration en matière de gestion de fonds pour le compte de leurs clients, notamment déclaration de soupçons et directives européennes anti-blanchiment. La fonction notariale a également évolué avec la création du statut du notaire salarié et le transfert de la procédure disciplinaire devant la chambre de discipline du conseil régional. La responsabilité civile notariale se caractérise, en effet, par la mise en oeuvre, parfois simultanée, d'une responsabilité disciplinaire, et moins fréquemment, d'une responsabilité pénale. Etayée par la jurisprudence la plus récente, l'analyse proposée donne une vision globale et concrète de l'étendue de la responsabilité notariale, des mécanismes de sa mise en oeuvre, et souligne son alourdissement ces trois branches. L'ouvrage est à jour des derniers textes de la matière, du décret du 24 octobre 2006, relatif aux notaires salariés, à l'ordonnance du 30 janvier 2009, sur la prévention de l'utilisation du système financier aux fins de blanchiment de capitaux et de financement du terrorisme. L'ouvrage s'adresse tout particulièrement aux notaires, magistrats, avocats, étudiants poursuivant des études de notariat, et aux organismes professionnels notariaux : chambres de notaires, caisses de garantie.
