Book excerpt: 'Proving' the cause of the plaintiff's injury in personal injury litigation often entails significant challenges, particularly when science cannot identify the cause of a biological phenomenon or when the nature of this cause is debatable. This problem is frequently encountered in medical malpractice cases, where the limitations of scientific knowledge are still extensive. Yet judges must decide cases, however uncertain the evidence with regard to proof of causation. Reluctant to leave patients without compensation, courts have in some cases challenged their traditional approach to causation through recourse to such techniques as reliance on factual presumptions and inferences, the concept of loss of chance, and reversal of the burden of proof. This book analyses and criticises the use of these various techniques by the courts of England, Australia, Canada, France, and the civilian Canadian province of Quebec in confronting evidentiary causal difficulties caused by the uncertainties of medical science.

Ce chapitre préliminaire, consacré aux généralités en la matière, s'avère en effet indispensable pour cerner de manière globale la responsabilité du médecin et en tracer les lignes directrices, avant de procéder à une étude plus détaillée de cette dernière. Ceci nous a conduit à déterminer d'une part la nature de cette responsabilité et d'autre part celle de l'obligation du médecin. Apres cette analyse générale, nous avons procédé à une étude approfondie du droit français et saoudien. On retrouve ici les trois éléments classiques de la responsabilité civile, à savoir la faute, le dommage et l'existence entre les deux d'un lien de causalité. La responsabilité du médecin ne peut être, en principe, engagée qu'en présence d'une faute commise par le médecin (thème développé dans notre première partie). La faute pouvant entraîner la responsabilité civile du médecin peut revêtir deux aspects. Il peut s'agir d'une violation de son devoir d'humanité (titre 1) ou d'une faute technique (titre 2), se traduisant par une négligence dans l'établissement du diagnostic, le choix ou l'application du traitement, ou par une certaine déficience dans la surveillance. Toutefois, avant d'envisager ces deux sortes de fautes, il nous a semblé nécessaire de consacrer un chapitre préliminaire à la définition de la faute médicale, sa notion et ses modalités d'appréciation. La faute du médecin doit entraîner un préjudice pour le malade, (sujet de notre deuxième partie) afin que ce dernier soit indemnisé. Il existe différents types de préjudices (titre i) qui ont été successivement envisagés ici, à savoir des préjudices dits classiques, ou d'autres plus spécifiques. Ceux-ci devront avoir un lien de causalité avec le comportement du médecin pour engager la responsabilité civile de celui-ci. Cependant, le médecin peut s'exonérer de sa responsabilité lorsque les causes du préjudice sont relatives au malade ou sont d'origine étrangère (titre 2).
