Sin embargo, para dar cabida a esas nuevas tipologías de daño en un ordenamiento resulta indispensable proponer un modelo coherente que las acoja, antes que la avalancha de esos nuevos intereses en busca de tutela aquiliana termine por desdibujar por completo la materia de la responsabilidad.Este es el propósito del presente trabajo, proponer, a partir de algunas experiencias del derecho comparado, y en particular del derecho italiano, un nuevo modelo de daños resarcibles a partir de la consolidación del daño a la salud, toda vez que dicha categoría, a diferencia de otras, permite ser considerada en términos iguales respecto de cualquier persona, y logra, además, desarrollar los principios constitucionales como guías del sistema que son.
