Pour ce faire, on a analysé parallèlement l'évolution de l'offre de crédit aux ménages et la progression de l'endettement des particuliers depuis la période moderne jusqu'à la fin des années 2000. Sur la base d'une méthodologie pluridisciplinaire, on a analysé plus particulièrement l'évolution du prêt personnel en prenant en compte son environnement institutionnel, les changements du marché du travail ainsi que les transformations des comportements des emprunteurs. Les forces de changement, et de non-changement, du cadre réglementaire et légal au cours de cette période ont fait l'objet d'une étude approfondie. Les tensions entre les acteurs (puissance publique, prêteurs, emprunteurs, avocats, société civile, et médias) et les conflits d'intérêts aboutissant in fine en 2006-2010 à la loi de réforme du marché des établissements de prêt à taux d'intérêt élevés, ont notamment été analysés pour rendre compte des facteurs du changement institutionnel appliqué à l'ensemble du marché du crédit aux consommateurs. La loi de 2006-2010 est donc analysée sous l'angle de la longue évolution des forces de pression entre le groupe « traditionnel » des établissements de prêt à taux d'intérêt élevés (kashikin gyôsha), et le groupe des avocats, dont l'influence économique et politique s'est renforcée progressivement depuis les années 1990 dans le contexte de crise économique et de succession de scandales. En effet, depuis les années 1970, les avocats activistes ont œuvré pour la prise de conscience sociale et juridique du surendettement (tajûsaimu) lié à un cumul de crédits chers et faciles auprès des établissements de prêt à taux d'intérêt élevés. Mais ce n'est qu'à partir des années 2000, grâce à plusieurs changements judiciaires et législatifs majeurs (réforme de la loi sur les faillites, procédure kabarai permettant aux emprunteurs de recouvrer une partie des taux ; d'intérêt payés aux établissements de prêt), que les avocats sont parvenus, en s'appuyant sur le soutien de l'opinion publique et des médias, à constituer une force de pression et influencer l'agenda politique du Premier ministre Koizumi Junichirô (2001-2006).
