Book excerpt: Esta obra se orienta a determinar la forma como debe ser aplicada la regla de exclusión de la prueba ilícita en el ámbito de la actuación civil, institución que si bien ha tenido un amplio desarrollo en el contexto del proceso penal. en el proceso civil no ha tenido tal cobertura. Para este propósito se analizó la evolución jurisprudencial y doctrinal que en punto de los mecanismos de supresión probatoria se han utilizado en los diversos sistemas jurídicos y que se mueven en el régimen de las nulidades procesales, característico de los procesos civiles en los modelos del civillaw, y el de la regla de exclusión, propio de los sistemas anglosajones del common law. Con base en esta consideración, el autor demuestra cómo, con motivo de la reforma Constitucional acontecida en Colombia en 1991, el régimen de las nulidades amplió su espectro a propósito de la inserción del inciso final del artículo 29 de dicha normativa, y ello incidió de igual manera en la forma como se deben concebir los mecanismos de supresión en ese contexto constitucional, para concluir, como en efecto se hace en la tesis, que en nuestro país se incorporó el régimen de supresión probatoria de la regla de exclusión y que es aplicable en el ámbito del proceso civil. en la medida en que aquel régimen coexiste con el de las nulidades procesales, y que a partir de los principios que caracterizan a este tipo de actuación procesal no es posible dar aplicación a los criterios atemperadores del efecto reflejo de la prueba ilícita, propios del proceso penal: vale decir, el vínculo atenuado, la fuente independiente y el descubrimiento inevitable.

A partir de este estudio de Derecho comparado, y trayendo a colación sentencias hito de América y Europa, se revisa brevemente la regla de exclusión y la teoría del árbol envenenado, así como lo relacionado con el tratamiento procesal de la prueba ilícita.

In Without Criteria, Steven Shaviro proposes and explores a philosophical fantasy: imagine a world in which Alfred North Whitehead takes the place of Martin Heidegger. What if Whitehead, instead of Heidegger, had set the agenda for postmodern thought? Heidegger asks, “Why is there something, rather than nothing?” Whitehead asks, “How is it that there is always something new?” In a world where everything from popular music to DNA is being sampled and recombined, argues Shaviro, Whitehead's question is the truly urgent one. Without Criteria is Shaviro's experiment in rethinking postmodern theory, especially the theory of aesthetics, from a point of view that hearkens back to Whitehead rather than Heidegger. In working through the ideas of Whitehead and Deleuze, Shaviro also appeals to Kant, arguing that certain aspects of Kant's thought pave the way for the philosophical “constructivism” embraced by both Whitehead and Deleuze. Kant, Whitehead, and Deleuze are not commonly grouped together, but the juxtaposition of them in Without Criteria helps to shed light on a variety of issues that are of concern to contemporary art and media practices.
