Book excerpt: La proximité connaît aujourd'hui un regain d'intérêt significatif, en apparaissant sous l'expression communément admise de «justice de proximité». Associée à la notion de justice, la proximité est entendue comme une qualité de l'appareil judiciaire. Pourtant, cette préoccupation n'est pas nouvelle pour la justice. Il est même possible de dire que celle-ci est très ancienne et continuellement présente dans son organisation et son exercice, mais aussi dans le langage de ses réformateurs. En outre, il n'existe pas dans la science juridique de définition clairement circonscrite de la proximité. Elle se révèle alors d'approche délicate en raison d'un usage contemporain manifestement excessif. Il existe en effet de multiple formes de proximité : géographique, humaine, du jugement, symbolique, temporelle etc. L'objet de la proximité en droit judiciaire est donc hétérogène et présente des manifestations traditionnelles et contemporaines très différentes. En outre, ses fonctions ont évolué, les traditionnelles ont été rénovées et corrigées pour tenir compte des évolutions de la société et des attentes des justiciables. Les nouvelles fonctions lui étant aujourd'hui attribuées permettent de s'interroger sur sa capacité à transformer la justice.

Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.

Pourtant, le point de vue du justiciable a jusqu'à présent moins retenu l'attention que les démarches institutionnelle ou procédurale. Cette carence revient à négliger le fait, bien connu depuis Sieyès et qui éclaire la crise contemporaine, que la confiance vient d'en bas. Si le devoir essentiel de rendre la justice a perduré de la royauté capétienne à l'Etat républicain, les maîtres successifs du pouvoir n'ont pu empêcher, en dépit de leurs proclamations incantatoires, la distorsion de s'accentuer entre la volonté officielle de proximité et l'éloignement effectif du service de justice. L'apport de notre époque est d'avoir conceptualisé la proximité judiciaire - principe toujours énoncé en faveur des particuliers, mais valeur plutôt que droit sanctionnable - laquelle se traduit par le souci concret d'une accessibilité extensive. Ainsi s'explique la mise en place de formes dites alternatives d'apaisement des conflits, qui laisserait à penser que nos réformateurs seraient bien inspirés d'acclimater les solutions qu'avancèrent les juristes du siècle des Lumières, scinder la reddition de la justice en deux tendances : la procédure contentieuse et les procédés gracieux. Mais la proximité doit-elle se parer pour autant d'un aspect systématiquement positif, conforme à ce que laisse supposer la vulgate dominante, qui voit dans un processus uniforme de rapprochement le remède à tous les maux des plaideurs ?

De ce constat naît une interrogation fondamentale : quel sens donner à la justice de proximité ? Distincte de la proximité de la justice, la justice de proximité doit être appréhendée dans sa double acception pénale et civile. Tandis que la justice pénale de proximité renvoie à un mouvement de diversification du circuit de traitement des infractions de faible et moyenne gravité par la recherche d'une ou plusieurs formes de rapprochement entre la justice et le citoyen, la justice civile de proximité vise, par cette même méthode, à améliorer l'accès à la justice des litiges dont l'enjeu économique est faible ou modéré. Ainsi entendue, la justice de proximité repose sur la mise en oeuvre d'une pluralité d'instruments procéduraux et organisationnels au sein de l'institution judiciaire. Leur examen révèle les ambiguïtés dont ils sont parfois porteurs ainsi que leur manque de lisibilité et de cohérence.
