Ce droit ne se résume pas au Code de la consommation et ne doit pas non plus se limiter à la simple protection de l'intérêt économique des consommateurs. La sécurité des individus est, elle aussi, une valeur essentielle, et elle déborde du domaine de la protection de leurs intérêts économiques dans la relation professionnel-consommateur. Dès lors, la question essentielle qui se pose est de savoir si le droit de la consommation, au sens traditionnel, est suffisamment armé pour protéger le consommateur contre les produits défectueux et les dommages qu'ils causent. Afin d'y répondre, cette étude entreprend une réflexion approfondie, portant notamment sur l'indépendance du droit de la consommation. Elle démontre que le droit de la consommation ne peut pas à lui tout seul assurer la protection des consommateurs et que celle-ci passe nécessairement aussi par le recours à d'autres branches du droit, en particulier au droit public, au droit pénal et au droit civil.

The fourth part of the book focuses on specific information obligations in the financial services and e-commerce sectors, discussing the fact that legislators are experimenting with different forms of summary disclosures in these sectors. The final part provides a critical appraisal of the recent developments in consumer information obligations, addressing the question of whether the multiple criticisms from behavioural sciences necessitate abandonment or refinement of current consumer information models in favour of new, more adequate forms of consumer protection, and providing suggestions.
