Cette réflexion autour de sa création et de son développement est le fait d’études de marché englobant le e-commerce. Cette stratégie d’implantation incluant les noms de domaines est souvent avantageuse mais révèle de nombreuses failles au niveau juridique. Non prévu par les législateurs, leur protection devient un souci récurrent pour tout propriétaire, leur défense se faisant au gré des jurisprudences. Un produit une fois installé sur le marché peut voir son originalité subordonnée. La contrefaçon et la concurrence déloyale constituent l’axe central d’atteinte à une marque. Le e-commerce frauduleux en est un des problèmes majeurs. Reste la contrefaçon dite classique. Issue de réseaux organisés, sa lutte est le fait de mesures douanières légales et d’une coordination internationale. La mondialisation a donné à la libre concurrence une signification nouvelle. En France, la protection de la marque s’est trouvée élargie entre autre grâce au rapprochement des droits de la consommation et de la marque. C’est ce lien d’abord voulu par le droit et la jurisprudence communautaire qui a progressivement fait émergé un droit européen de la marque. La notion d’épuisement du droit en est une particularité et annonce ce que sera la marque de demain. De ce qu’il précède et quelque soit la forme de son exploitation, la protection de la marque jusque là prévue doit être complétée dans les deux pays.

Book excerpt: L'objet de cette thèse c'est de répondre à la question si le droit de marque peut être considéré comme le droit de propriété. Par conséquent cette question - de la nature de la maque - semble avoir une grande importance pratique : la réponse sur l'étendue de la protection résultant du droit sur la marque permet en effet de déterminer les cas d'atteinte au droit de marque et les cas d'usage de la marque qui restent dehors du monopole du propriétaire de la marque. Dans un premier temps, il faut avancer la thèse que la qualification du droit de marque en tant que propriété peut être contestable du point de vue des fonctions de la marque qui se trouvent au cœur du droit des marques. Les définitions des marques incluses dans les lois nationales montrent déjà qu'un signe peut constituer une marque, lorsqu'il fournit une fonction de distinction. Par conséquent, on indique que la marque ce n'est pas le signe lui-même, mais un signe qui est capable de distinguer les produits sur le marché. Cette fonction, essentielle, nommée aussi fonction de garantie d'origine, c'est la condition sine qua non d'obtention de l'enregistrement d'un signe en tant que marque et, par conséquent, permettant au signe de jouer le rôle de marque. Le deuxième argument conteste la qualification propriétaire du droit de marque en raison de l'exclusivité limitée à certains usages de la marque L'idée est de savoir quel doit être le caractère d'usage d'une marque d'autrui par un tiers pour que cet usage puisse être qualifié de contrefaçon. D'où la conclusion qui s'impose : ce n'est pas un usage quelconque de la marque qui constitue une atteinte au droit de marque.

Si l'on part du principe selon lequel, les éléments constitutifs doivent être définis et protégés, l'analyse exige que l'on examine les mécanismes des sanctions civiles et pénales, et surtout que l'on se penche sur le rôle de la convention d'Union de Paris de 1883,révisée plusieurs fois, et dont le Maroc est signataire depuis une trentaine d'années. Dans notre approche, nous avons veillé à ne pas négliger l'aspect délicat et sensible du droit moral de l'invention. Il faut dire que, si on le compare aux prérogatives du droit moral accordé aux droits d'auteur, celui-ci ne bénéficie que d'un contenu limité. Par ailleurs, et a contrario, on constatera que la jurisprudence est très fournie en matière de marque de fabrique, en concurrence déloyales, en contrefaçon et infractions bicéphales, disposant d'un pouvoir très étendu en matière de sanction civile et pénale

The aim of this collection of texts is to propose a number of specific measures member states can take to help adult migrants become acquainted with the language of the host country. It is not enough for authorities simply to consider the technical aspects of such courses, they should also design and conduct them in accordance with the fundamental values of the Council of Europe. Book excerpt: Malaysia came into existence on 9/16/63 as a federation of Malaya, Singapore, Sabah (North Borneo), and Sarawak; in 1965 Singapore withdrew from the federation. Offers an in-depth and detailed analysis of the political processes that led to formation of the Federation of Malaysia in 1963. It argues that the Malaysia that came into being following the amalgamation of Malaya, Singapore, Sarawak and North Borneo was a political creation whose only rationale was that it served a convergence of political and economic expediency for the departing colonial power, the Malayan leadership and the ruling party of self-governing Singapore. 'Greater Malaysia' was thus an artificial political entity, the outcome of a concatenation of interests and motives of a number of political actors in London and Southeast Asia from the 1950s to the early 1960s. This led to a number of unresolved compromises between Singapore and Kuala Lumpur and did not obviate the possibility of future difficulties, and the seeds of dissension sown by the disagreements between the two governments were to sprout into major crises during Singapore's brief history in the Federation of Malaysia.
