Book excerpt: La Ley 26/2007, de 23 de octubre, de responsabilidad medioambiental, introduce en nuestro Derecho un mecanismo amplísimo de reparación y prevención de daños al medio ambiente. Inspirada en el principio de que «quien contamina paga», persigue que los daños medioambientales sean reparados de una forma rápida y adecuada. Para ello, establece una regla de responsabilidad objetiva e ilimitada, con una potente presunción del nexo causal. El potencial de responsabilidad del nuevo régimen legal, más severo que la Directiva europea que transpone, es enorme. Con ello, da un paso hacia la indemnización de daños que, aunque no afecten a personas concretas, sí perjudican a la colectividad en su conjunto, por suponer un deterioro del medio ambiente como tal. En lugar de la responsabilidad civil clásica, se ha optado por un mecanismo de responsabilidad de perfiles jurídico-públicos, que incluye a los daños ecológicos puros y atribuye a la autoridad pública un papel capital. Por ello, el presente libro examina este régimen de responsabilidad en relación con esos daños ecológicos puros y se pregunta en qué medida han quedado comprendidos por la nueva responsabilidad ambiental. Teniendo en cuenta nuestro Derecho patrio y el de otros países de nuestro entorno, estudia críticamente el daño medioambiental indemnizable -clave del alcance del nuevo régimen legal- así como la presunción de causalidad y otros mecanismos de facilitación probatoria, las causas de exoneración, las formas de reparación, las garantías y la relación con otros supuestos de responsabilidad, los sujetos responsables o legitimados para reclamar; en suma, el alcance de la ley y sus posibles insuficiencias. La tesis doctoral en que se basa esta obra ha sido distiguida con el premio Sancho Rebullida a la mejor tesis doctoral presentada en 2007.

This need for "sustainable development" is and more by the responsible parties. Moreover, in the being recognised more search for solution strategies the realisation is gaining ground that tourism must be viewed as a worldwide phenomenon whose development must be co-ordinated in a co-operative effort spanning regions and continents. That the preservation of biological diversity also requires global co operation has been confirmed by over 170 countries which have already acceded to the "Convention on Biological Diversity". It is thus an important task to provide the foundations for joint action. Germany, one of the largest source countries of international tourism, must feel particularly obligated in this regard. The report published here is the result of a research project com missioned by the German Federal Agency for Nature Conservation. The study pursued and examined the thesis that the Convention on Biological Diversity be used as a central instrument for arriving at international principles and regulations for combining nature conservation and tourism which could lead to a sustainable development of tourism. To further the discussion, the authors brought the study to a logical conclusion by working out a proposal for a "tourism protocol" additional to the existing Convention on Biodiversity. Such a protocol additional to the Convention would entail the stipulation of internationally binding implementation and regulations for achieving sustainable tourism.

Book excerpt: Payments for Environmental Services (PES) are being considered worldwide with great interest and expectation. Proposals to create agreements in which beneficiaries of environmental services pay landowners directly for the provision or protection of these services are innovative and promising. But what real PES experiences are actually out there? This work assesses a range of PES or PES-type experiences in one country, Bolivia, in the fields of carbon sequestration, protection of watershed services, biodiversity and aesthetic landscape values. The report concludes that while none of the generally young initiatives adhere fully to the principle of PES as developed in the theoretical literature, many experiment with some of the relevant PES mechanisms. Protection of watersheds and landscape values are the most common types, though the implementing intermediaries often have underlying biodiversity-protection goals. Main obstacles to PES implementation include ideological resistance against the PES concept, the difficulty of building trust between buyers and sellers, and limited willingness to pay on behalf of service users. During their relatively short lifetime, basically all initiatives had been successful in making service sellers (PES recipients) better off in economic terms, while the effectiveness in achieving environmental objectives and securing positive social impacts so far remained more variable. In some cases, redesigning these initiatives to bring them closer to the full PES principles could also enable them to more effectively achieve positive environmental and livelihood outcomes.
