Book excerpt: Este libro explica cuáles son las reglas de responsabilidad extracontractual del Derecho español aplicables a los daños que pueden sufrir en su integridad psicofísica o en sus bienes quienes usan o consumen productos (botellas que explotan, intoxicaciones alimentarias, efectos secundarios de medicamentos...) o reciben la prestación de servicios defectuosos (reparaciones de vehículos o ascensores, intervención quirúrgica que provoca la muerte, instalación o revisión de gas deficientes...). Los daños pueden padecerlos también quienes no son considerados consumidores en sentido legal, pero el principio constitucional de protección del consumidor exige una mayor protección a las víctimas, lo que dio lugar a la promulgación de un régimen específico de responsabilidad. Sin embargo, la presencia de otras finalidades e intereses, como la armonización de las normas de los Estados para garantizar la libre circulación de las mercancías en el mercado interior de la Unión Europea o la posibilidad de lograr seguros de responsabilidad más baratos, ha propiciado la promulgación de normas que suponen un recorte en la protección de los intereses de los consumidores. Junto a ello, el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios regula de manera conjunta la responsabilidad del suministrador de un servicio y la del fabricante de productos defectuosos, pero la relación entre ambos regímenes es extremadamente difícil. Este libro ofrece respuestas a los complejos problemas de interpretación que se plantean en el ámbito de los daños a consumidores (¿quién debe responder?, ¿de qué daños?, ¿con arreglo a qué régimen de responsabilidad?). Dirigido fundamentalmente a los aplicadores del Derecho, en especial a abogados, jueces y magistrados, también presenta interés para otros profesionales jurídicos dedicados al Derecho del consumo, así como para los empresarios y profesionales que son responsables de los daños causados por los productos que introducen en el mercado o por los servicios que prestan. Bringing together legal scholars from the Global South and the Global North, it examines these questions in the context of national, transnational and international law, within single and plural legal systems, and across a range of sector-specific issue areas. The chapters identify how traditional legal disciplines (e.g. constitutional law, consumer law, public procurement, international public law), sector-related regulation (e.g. energy, water, waste), and legal rules in specific areas (e.g. eco-labelling and packing) engage with the concept of sustainable consumption. A number of the contributions describe this relationship by isolating a national legal system, while others approach it from the vantage point of legal pluralism, exploring the conflicts and convergences of rules between multiple international treaties (or guidelines) and those between the rules of international and transnational law (or both) vis-à-vis national legal systems. While sustainable consumption is recognised as an important field of interdisciplinary research linking virtually all social science disciplines, legal scholarship, in contrast, has neglected the importance of the field of sustainable consumption to the law.
