Book excerpt: Desde que se instaurara el nuevo modelo de relaciones entre el Estado y las distintas confesiones religiosas, incluida la Católica, uno de los problemas más importantes ha sido el acceso al Registro de Entidades Religiosas, pues éste ha condicionado la adquisición de la personalidad jurídica y de la capacidad de obrar.La praxis administrativa, con numerosas denegaciones de inscripción desde que se instituyera el Registro mencionado, en 1981, ha sido buena prueba de ello. El presente trabajo aborda dicha problemática desde una perspectiva eclesiasticista, pero también constitucional, ya que, desde esta doble óptica, el derecho a la vida de las personas jurídicas en un derecho fundamental, dimanante del derecho de la libertad religiosa, pero también de la libertad de asociación, extrayendo de esta conclusión numerosas consecuencias.Tras un análisis histórico en el que el autor constata cómo los Registros del Estado han servido a éste para controlar los diferentes fenómenos asociativos, se aborda en profundidad el régimen jurídico de las entidades religiosas, los requisitos y el procedimiento de inscripción, su estatuto jurídico, los derechos de las entidades no inscritas y cuál ha sido la praxis administrativa y la práctica de los Tribunales, con cita exhaustiva de las Resoluciones recaídas y un importante anexo de especial importancia teórica, aunque de no menos trascendencia práctica para aquellas Iglesias, Confesiones o Comunidades religiosas, o sus asociaciones, que pretendan inmatricularse.Es éste, en suma, un tratado completo, riguroso y crítico, del imperfecto modelo de otorgamiento de la personalidad jurídica a los entes confesionales, lo que reclama la necesidad de arbitrar mecanismos correctores -que el autor propone- y, por supuesto, la necesidad de reformar profundamente el sistema.
