Book excerpt: This book is formed by various chapters studying the manner in which conflicts, changes and ideologies appear in contemporary Hispanic discourses. The contributions analyze a wide variety of topics related to the manner in which ideological and epistemological changes of the 19th, 20th and 21st centuries are reflected in, and shape, Spanish language, literature, and other cultural expressions in both Spain and Latin America. The 19th century was conducive to various movements of independence, while, in Europe, radical changes of different types and in all contexts of life and knowledge occurred. Language was certainly affected by these changes resulting in new terminology and discourse strategies. Likewise, new schools of thought such as idealism, dialectic materialism, nihilism, and nationalism, among others, were established, in addition to new literary movements such as romanticism, evocative of (r)evolution, individualism and realism, inspired by the social effects of capitalism. Scientific and technological advances continued throughout the 20th century, when the women’s liberation movement consolidated. The notion of globalization also appears, simultaneously to various crises, despotism, wars, genocide, social exclusion and unemployment. Together, these trends give rise to a vindicating discourse that reaches large audiences via television. The classic rhetoric undergoes some changes given the explicit suasion and the absence of delusion provided by other means of communication. The 21st century is defined by the flood of information and the overpowering presence of mass communication; so much so, that the technological impact is clear in all realms of life. From the linguistic viewpoint, the appearance of anglicisms and technicalities mirrors the impact of post-modernity. There is now a need to give coherence to a national discourse that both grasps the past and adapts itself to the new available resources with the purpose of conveying an effective and attractive message to a very large audience. Discourse is swift, since society does not seem to have time to think, but instead seeks to maintain interest in a world filled with stimuli that, in turn, change constantly. Emphasis has been switched to a search for historical images and moments that presumably explain present and future events. It is also significant that all this restlessness is discussed and explained via new means such as the world-wide-web. The change in communication habits (e-mail, chats, forums, SMS) and tools (computers, mobile phones) that was initiated in the 20th century has had a net effect on the directness and swiftness of language.

In fact, in deciding to publish the arbitration clauses and arbitral awards from 1794 to 1900, Henri La Fontaine was doing pioneering work, foreshadowing the famous Reports by half a century. As we near the end of the century, the 'Pasicrisie internationale' remains just as pertinent as it was when first published in 1902. This collection of arbitral awards, with its modest appearance, has certainly contributed more to the development of international arbitration case law than any number of lyrical speeches advocating peace through law. First edition printed in 1902 by Stämpfli, Bern. Lorsque l'Organisation des Nations Unies entreprit la publication de son Recueil des sentences arbitrales, elle identifia la Pasicrisie internationale comme constituant l'une des rares véritables collections générales de jurisprudence internationale préexistantes. De fait, en décidant de rassembler les clauses compromissoires et les sentences arbitrales de 1794 à1900, Henri La Fontaine avait fait oeuvre de pionnier et il préfigurait, avec un demi-siècle d'avance, le célèbre Recueil. En cette fin de siècle, la Pasicrisie internationale constitue donc un outil de travail toujours aussi actuel que lors de sa publication en 1902. Book excerpt: This study analyses the legal condition of women in Catalonia, Spain, in the early modern ages, particularly during the seventeenth and eighteenth centuries, by way of the study of primary legal sources. The legal discourse was conceived as being different for men and women: women were treated as a specific social category, were judicially discriminated against and were given inferior legal personality. Following the moral discourse of the time, jurists classified women as honest and dishonest, and tried to establish a physical and legal barrier to divide the good from the bad. As a result, women were before the law, pawns for male decisions. However, women did not easily comply with the submissive role attributed to them and, as civil lawsuits show, often they used the law that discriminated them in their own benefit.

This decision laid the first stone of the principle that an agreement to commit a crime is also a crime. However, besides what the law reports say, little is known about the facts of the case. This edition of the testimonies collected by the Star Chamber intends to fill this gap. Additionally, an introductory study will discuss how these facts shed new light on the reasons that were mustered in support of the decision. It will also argue that modern conspiracy was not a creation of the courts but rather of the nineteenth-century scholars who turned the Poulterers' Case into a landmark case.Todo estudiante angloamericano de derecho penal sabe que el Poulterers’s Case (1611) dio el primer paso hacia el delito moderno de conspiración en Inglaterra.
