The thesis begins with a comparison of British copyright and French droit d'auteur, and goes through a historical survey of licenses and printing privileges in both countries, including the Statute of Anne of 1710 as well as the Fine Arts Act of 1862 in Britain, and La loi du 19 juillet 1793 in France. The core of the thesis is a reading of selected legal cases in Britain and France from the early 19th century to the present. Cases concerning works of art and literature are closely analyzed and compared in terms of their concern and consequences for the scope of protection, the justification for copyright, the concept of the work and of the author/creator, the notion of originality, and the concepts of copying and infringement. Cases are presented chronologically in order to expose trends and developments. It presents, in outline, a conceptual history of reproduction (as substitution, as multiplication, as appropriation), in order to understand the legal conflicts and inconsistencies in copyright law. These particularly concern the disparity between the ownership of an immaterial work and that of its material manifestation, as well as the lack of an appropriate legal distinction between images and texts. Many studies on translation and cultural mediation privileged the major metropolis of Paris, London, and New York as centres of cultural production and translation. However, other cities and megacities that are not global centres of culture also feature vibrant translation scenes. This book abandons the focus on ‘innovative’ centres and ‘imitative’ peripheries and follows processes of cultural exchange as they develop. Thus, it analyses the role of cultural mediators as customs officers or smugglers (or both in different proportions) in so-called ‘peripheral’ cultures and offers insights into an under-analysed body of actors and institutions promoting intercultural transfer in often multilingual and less studied venues such as Trieste, Tel Aviv, Buenos Aires, Lima, Lahore, or Cape Town.

He was also, as this volume demonstrates, a maniacal taxonomist. In this zoological guidebook to cuckoldry and commerce, Fourier offers a caustic critique of the bankruptcy of marriage and the prostitution of the economy, and the hypocrisies of a civilization that over-regulates sexual congress while allowing the financial sector to screw over the public. Gathered together here for the first time are Fourier's two "Hierarchies" --humorously regimented parades of civilization's cheaters and cheated-on in the domestic sphere of sex and the economic sphere of buying and selling commodities. "The Hierarchy of Cuckoldry" --translated into English for the first time--presents 72 species of the male cuckold, ranging from such "common class" cases as the Health-Conscious Cuckolds, to the short-horned Sympathetic, Optimist and Mystical Cuckolds, and the Long-horned varieties of the Irate, Disgraced and Posthumous Cuckolds. For Fourier, these amount to 72 manifestations of women's "secret insurrection" against the institution of marriage. "The Hierarchy of Bankruptcy" presents 36 species of the fraudulent bankrupt: a range of Light, Grandiose, and Contemptible shades of financial manipulators who force creditors, cities and even nations to bail them out of ultimately profitable bankruptcies. In these attacks on the morality of monogamy and the perils of laissez-faire capitalism, Fourier's "Hierarchies" resonate uncannily with our contemporary world.

In tracing the explosion of literary translation in nineteenth-century Russia, Friedberg determines that it introduced new issues of cultural, aesthetic, and political values. Beginning with Pushkin in the early nineteenth century, Friedberg traces the history of translation throughout the lives of Dostoevsky, Tolstoy, and, more recently, Pasternak. His analysis includes two translators who became Russia's leading literary figures: Zhukovsky, whose renditions of German poetry became famous, and Vvedensky, who introduced Charles Dickens to Russia. In the twentieth century, Friedberg points to Pasternak's Faust to show how apolitical authors welcomed free translation, which offered them an alternative to the original writing from which they had been banned by Soviet authorities. By introducing Western literary works, Russian translators provided new models for Russian literature. Friedberg discusses the usual battles fought between partisans of literalism and of free translation, the influence of Stalinist Soviet government on literary translation, and the political implications of aesthetic clashes. He also considers the impetus of translated Western fiction, poetry, and drama as remaining links to Western civilization during the decades of Russia's isolation from the West. Friedberg argues that literary translation had a profound effect on Russia by helping to erode the Soviet Union's isolation, which ultimately came to an end with the dissolution of the Soviet Union in 1991.
