Book excerpt: La sospensione del processo per messa alla prova dell’imputato adulto, introdotta dalla l. 28 aprile 2014, n. 67, è un istituto complesso e proteiforme. La scelta del legislatore di attribuire alla messa alla prova una doppia natura, causa di estinzione del reato e procedimento speciale, ha condotto alla redazione di disposizioni collocate sia nel Codice penale sia in quello di rito. Il meccanismo di diversion consente all’imputato di allontanarsi dal processo ordinario in modo condizionato, fuoriuscendone definitivamente, qualora la prova abbia esito positivo, dopo aver percorso un binario parallelo rappresentato da un vero e proprio esperimento trattamentale. La sospensione del processo per messa alla prova infrange la sequenza tra reato e pena. Ne derivano sfide interpretative di non poca misura: alcune possono essere affrontate a livello pretorio, altre necessitano delle pronunce della Consulta e altre ancora sembrano esigere interventi legislativi ulteriori.
