Book excerpt: Il presente lavoro, ha per oggetto lo studio delle modalità con cui sono applicati i principi della giustizia riparativa, e in particolare della mediazione penale, nell'ambito del nostro ordinamento giudiziario minorile In particolare nel primo capitolo, sono ripercosse le ragioni storiche che hanno consentito l'affermarsi all'interno degli ordinamenti giudiziari occidentali dei principi di un nuovo modello di giustizia, quello riparativo. Tale analisi non ha potuto prescindere dallo studio delle principali fonti internazionali, che hanno favorito la diffusione più o meno rapida in quasi tutti i paesi occidentali di questa nuova forma di giustizia. La sua diffusione nel mondo giuridico è avvenuta secondo due principali modelli, quello francese e quello anglosassone, che nel presente lavoro sono stati oggetto di studio. Il legislatore, in conformità con le principali fonti internazionali e costituzionali, ha deciso di attribuire al processo penale a carico del minorenne soprattutto la finalità educativa e responsabilizzante. Il secondo capitolo è dedicato allo studio dei principi che caratterizzano il processo penale minorile introdotto con il D.p.r. 22 settembre n. 448/88. In particolare, il presente studio concentra il suo sguardo su gli istituti giuridici del proscioglimento per immaturità, della sentenza di non luogo a procedere per irrilevanza del fatto, del perdono giudiziale e dell'estinzione del reato per esito positivo della prova che, ispirati al principio della minima offensività, consentono la definizione anticipata del processo a carico dell'imputato minorenne. Questi istituti giuridici, vengono in rilievo anche perché hanno consentito l'introduzione della mediazione penale all'interno del processo. Il terzo capitolo è invece dedicato alla mediazione penale minorile. Quest'analisi parte dallo studio delle norme del D.P.R. n. 448 del 1988 che consentono di dare rilevanza giuridica al percorso di mediazione intrapreso dal minore autore del reato con la sua vittima. In particolare, si distinguono una mediazione in fase pre-processuale nell'ambito delle indagini preliminari, e una mediazione in fase processuale. È fatta poi una breve analisi di come sono costituiti gli Uffici per la mediazione penale minorile, e di come si è organizzato il personale che lavora all'interno di questi Centri.
