Con esta idea, cuando tratamos el acceso a la justicia debemos comprender todas las fórmulas previstas en Derecho, tanto las extrajudiciales como las judiciales dentro del proceso. El objetivo de este estudio es analizar y evaluar de manera crítica las distintas vías de introducción de la mediación en conflictos individuales de trabajo en España. Los resultados obtenidos nos muestran que seguimos recurriendo al juzgado para la resolución de nuestros conflictos. Sin embargo, el cambio de paradigma que supone que las partes de una controversia participen de su solución es ya imparable. Aún así, la aportación de instituciones internacionales, nacionales y autonómicas para introducir la mediación en conflictos de trabajo está teniendo un alcance exiguo en términos generales.Se evidencia que no existe ni regulación específica, ni planificación estructural a nivel nacional, ni si quiera autonómica, ni financiación mínima garantizada que asegure un óptimo funcionamiento estructurado. Finalmente, se pone de manifiesto la necesidad de lograr una coordinación estratégica de recursos personales y materiales única que evite duplicidades, creando un centro de mediación laboral que garantice las mismas oportunidades de obtener una solución a los conflictos laborales de las personas trabajadoras, sean de la comunidad autónoma que sean.
