Book excerpt: Traditionnellement, le droit des marques de commerce canadien a toujours offert une protection relativement efficace aux titulaires de marques contre la violation de la fonction "indicateur de provenance" des marchandises ou services vendus en liaison avec une marque de commerce donnée. Le titulaire d'une marque déposée peut ainsi exercer un recours statutaire en contrefaçon alors que le titulaire d'une marque employée peut entreprendre un recours en usurpation de marque (“ passing-off ¿) contre tout tiers qui emploie une marque similaire ou identique qui crée de la confusion dans l'esprit des consommateurs quant à la source ou à la provenance des marchandises ou services. Cette forme de protection vise à protéger le titulaire d'une marque contre le détournement de clientèle. Cependant, lorsqu'un geste posé par une tierce partie porte plutôt atteinte à la réputation d'une marque de commerce, entraîne une perte de contrôle de la marque ou déprécie la valeur de l'achalandage relié à celle-ci, il y a plutôt lieu de parler de "dilution" de la marque de commerce. La protection contre la dilution de marque, tant par brouillage que par dénigrement, vise pour sa part à protéger la fonction "publicitaire" ou "identitaire" de la marque, à tout le moins pour la marque qui jouit d'un caractère distinctif inhérent fort et d'une notoriété. Comme prémisse, ce mémoire entend donc établir que le droit des marques de commerce canadien, plus particulièrement la L.M.C., devrait comporter des dispositions statutaires capables d'assurer la protection adéquate des marques tant de leur fonction indication d'origine que de leur fonction publicitaire, et ce, au moyen d'un ou de plusieurs recours statutaire(s) efficace(s). Par conséquent, le présent mémoire aura pour objet de déterminer si la L.M.C., dans sa version actuelle, confère au titulaire d'une marque de commerce un ou des recours statutaire(s) afin de contrer efficacement la dilution. Si oui, il y aura particulièrement lieu de se demander si le libellé de l'article 22 et de l'alinéa 7a) L.M.C. et l'interprétation qui en est faite favorise une protection adéquate des titulaires de marques de commerce distinctives et notoires contre la dilution quelle que soit la forme d'atteinte posée par un tiers? En somme, le présent. mémoire aura pour objet de déterminer si la L.M.C, permet effectivement au titulaire d'une marque de se défendre contre des atteintes à la fonction publicitaire de sa marque lesquelles peuvent se manifester dans le cadre de publicités comparatives, de parodies, d'emploi générique d'une marque, d'emploi d'une marque dans un nom de domaine de critique ou encore dans différentes circonstances mettant en péril le contrôle de la marque par son titulaire.

C'est dans cet objectif que la Convention de l'Union de Paris détermine certains principes généraux de la protection de la propriété industrielle dans l'ordre international. En Lybie, la protection des marques a été instituée par la loi n°40/1956. Un Bureau des marques commerciales a été alors instauré au sein du ministère de l'économie. La loi n°08/1959 a développé l'organisation de ce bureau et lui a donné compétence pour les demandes d'enregistrement des marques, des brevets, dessins et modèles industriels. Le titulaire d'une marque enregistrée en Lybie bénéficie de tous les droits attachés à la propriété de la marque. La reproduction, l'imitation, l'apposition d'une marque sans être titulaire des droits de propriété sont des infractions qui entrent dans la catégorie des délits. La nouvelle loi n°23/2010, qui n'est pas encore applicable, renforce la protection des marques et protège davantage le consommateur par le regroupement des règles relatives aux indications commerciales avec celles relatives à la marque. De plus, pour servir cet objectif, cette loi adopte les règles relatives à la concurrence en interdisant, notamment, la concurrence déloyale. Pour autant, la loi nouvelle n°23/2010 devrait être encore révisée pour prendre en considération l'ensemble des règles posées par la Convention de l'Union de Paris qui devrait servir de référence à la loi interne libyenne relative à la propriété industrielle. Ainsi, le Bureau des marques commerciales ou tout ayant droit pourrait réclamer l'interprétation de la loi interne en considération de la Convention de l'Union de Paris. Cette démarche permet d'établir une relation directe entre la loi interne et le droit international dans le domaine de la propriété industrielle, elle assure également que l'État libyen respecte ses obligations internationales relatives au droit des marques.

The Government originally announced proposals for modernising the London Underground network system via Public-Private Partnership (PPP) agreements in 1998. Three contracts were drawn up with: (i) Tube Lines for the maintenance and renewal of the Jubilee, Piccadilly and Northern Lines; (ii) with Metronet Rail BVC for the maintenance and renewal of the Bakerloo, Central, Victoria & Waterloo & City Lines; (iii) with Metronet Rail SSL, responsible for the maintenance and renewal of the "sub-surface lines": the Circle, District, Hammersmith & City, Metropolitan & East London Lines. These PPP Agreements, 30 years in duration, were arrangements to maintain, renew and upgrade parts of London Underground by private sector infrastructure companies (Infracos), whilst London Underground is responsible for services to customers. The PPP Agreements also set out a performance-related incentive and penalty scheme to remunerate the Infracos for the improvements they make to the network. In May 2007, Metronet admitted an overspend of £1 billion and was refused access to loan facilities by the banks. It then made a reference to the PPP Arbiter, which in turn triggered an Extraordinary Review (which occurs when extra costs are incurred above the level allowed for the bid). Metronet put in a bid for £551m but the PPP Arbiter provisionally concluded that a sum of £121m was appropriate. Metronet subsequently went into administration on 18 July 2007. The report sets out a number of conclusions and recommendations, including: contracts that were supposed to deliver 35 station upgrades, in fact delivered only 14, 40% of the requirement; stations that were supposed to cost Metronet SSL £2m, cost £7.5m, with only 65% of schedule track renewal accomplished; the Committee criticises the consequences of the imposition of PPP on Transport for London, as a "lamentable state of affairs", with the future of most of London Underground's upgrade and maintenance work in doubt; the Committee states, that the Government should remember the failure of Metronet before it considers entering similar arrangements; that the Government should publish a candid analysis of the events preceding Metronet's collapse and its consequences; the Committee believe that the PPP model was flawed and probably inferior to traditional public-sector management; that the Government needs to prioritise transparency and clarity to taxpayers and ensure that any future contracts result in clear accountability.

Brown applies this theory of transformational processes to a variety of topics, including the analyst’s receptivity, countertransference as transformation, the analytic setting, the paintings of J.M.W. Turner, "autistic transformations" and other clinical situations in the analysis of children and adults. He believes in the importance of converting reveries into verbal interpretations, a controversial point amongst post-Bionians. Busch ends with the difficult task of classifying the analyst’s reveries based on their degree of representation. The Analyst's Reveries will be of great interest to psychoanalysts and psychoanalytic psychotherapists.

The therapeutic task is now seen by an increasing number of analysts to require that patient and analyst work together to strengthen, or to create, psychic structure that was previously weak, missing, or functionally inoperative. This view, which may apply to all patients, but is especially relevant to the treatment of non-neurotic patients and states of mind, stands in stark contrast to the more traditional assumption that the therapeutic task involves the uncovering of the unconscious dimension of a present pathological compromise formation that holds a potentially healthy ego in thrall. The contrast which this book calls attention to is that which exists roughly between formulations of psychic structure and functioning that were once assumed to have been sufficiently well explained by the hypotheses of Freud's topographic theory and those that were not. The former are modeled on neurosis and dream interpretation, where conflicts between relatively well-defined (saturated) and psychically represented desires were assumed to operate under the aegis of the pleasure-unpleasure principle.
