Book excerpt: Le principe de la libre circulation des personnes est un thème majeur de la construction européenne. Il s'est vite affranchi de sa finalité économique pour devenir une liberté publique communautaire de premier rang, liée ensuite à la mise en œuvre de la citoyenneté européenne. Dès lors, ce principe, tel qu'affirmé par le traité de Rome, n'a cessé de se développer. Son étude montre en effet que, dès 1968, un règlement d'application relatif à la "libre circulation des travailleurs et des membres de leur famille" fait entrer la problématique des droits fondamentaux au sein du droit communautaire. Cette introduction fait alors naître des interrogations, aujourd'hui relayées par l'entrée en vigueur du traité d'Amsterdam et la proclamation récente d'une charte communautaire des droits fondamentaux. La confrontation entre la libre circulation des personnes et les droits fondamentaux se lit en termes de hiérarchie. Un véritable rapport de soumission de la libre circulation des personnes au respect des droits fondamentaux se dégage de l'ensemble de l'appareil normatif recensé, y compris jusque dans les limites fixées par les états membres eux-mêmes. Un examen attentif du traité communautaire, des conventions internationales, des normes de droit dérivé, de la jurisprudence communautaire et de la jurisprudence européenne témoigne de ce rapport hiérarchique. Mais, l'étude de la problématique de la soumission permet de mettre en lumière un catalogue des droits de la personne dont le contenu jurisprudentiel est repris, dans son intégralité, par la charte communautaire des droits fondamentaux. Ce faisant, la montée en puissance d'un "droit communautaire des droits fondamentaux" vient directement compléter l'affirmation jurisprudentielle européenne d'un "ordre public" des droits de l'homme. La présence d'un système de garanties politiques et juridictionnelles est là pour assurer l'effectivité des droits fondamentaux. Ainsi, la libre circulation des personnes offre les prémices d'un mouvement plus général qui va concerner l'ensemble des politiques de l'union européenne.

Organized by the REHSEIS group (Research on Epistemology and History of Exact Sciences and Scientific Institutions) of CNRS (National Center for Scientific Research), the colloquium was held from 3 to 6 April 1990 in the UNESCO building in Paris. This colloquium was an idea of Professor Roshdi Rashed who initiated this field of studies in France some years ago, and proposed "Sciences and Empires" as one of the main research programmes for the The project to organize such a colloquium was a bit REHSEIS group. of a gamble. Its subject, reflected in the title "Sciences and Empires", is not a currently-accepted sub-discipline of the history of science; rather, it refers to a set of questions which found autonomy only recently. The terminology was strongly debated by the participants and, as is frequently suggested in this book, awaits fuller clarification.

Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups
