Book excerpt: Article 9 of the European Convention on Human Rights guarantees freedom of thought, conscience and religion. The protection it affords is of such significance that the judges of the European Court of Human Rights regard it as one of the cornerstones of d'mocratic society. The freedoms Article 9 guarantees have two essential aspects: internal, covering the freedom to hold convictions and beliefs, and external, covering the freedom to manifest one's convictions and beliefs. The first of these freedoms is absolute, the second relative, but in neither case can their importance be undervalued.

Download or read book Law Religion Constitution written by W. Cole Durham and published by Routledge. This book was released on 2016-04-29 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: What is the place assigned to religion in the constitutions of contemporary States? What role is religion expected to perform in the fields that are the object of constitutional regulation? Is separation of religion and politics a necessary precondition for democracy and the rule of law? These questions are addressed in this book through an analysis of the constitutional texts that are in force in different parts of the world. Constitutions are at the centre of almost all contemporary legal systems and provide the principles and values that inspire the action of the national law-makers. After a discussion of some topics that are central to the constitutional regulation of religion, the book considers a number of national systems covering countries with a variety of religious and cultural backgrounds. The final section of the book is devoted to the discussion of the constitutional regulation of some particularly controversial issues, such as religious education, the relation between freedom of speech and freedom of religion, abortion, and freedom of conscience.
Download or read book Freedom of Religion written by Renáta Uitz and published by Council of Europe. This book was released on 2007-01-01 with total page 183 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Universal Declaration of Human Rights and the European Convention on Human Rights proclaim that everyone has the right to freedom of thought, conscience and religion, including freedom to manifest their religion or belief in worship, teaching, practice and observance. Even today, in democratic societies too, this fundamental right is still sometimes restricted and meets with hostility and intolerance. Using concrete examples, the author compares and analyzes the protection of the right to freedom of religion in the case-law of European constitutional courts and of the European Court of Human Rights of the Council of Europe, in order to establish whether there is such a thing as general European law in this sphere.--Publisher's description.
Download or read book Religious Actors and International Law written by Ioana Cismas and published by OUP Oxford. This book was released on 2014-07-17 with total page 385 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book assesses whether a new category of religious actors has been constructed within international law. Religious actors, through their interpretations of the religion(s) they are associated with, uphold and promote, or indeed may transform, potentially oppressive structures or discriminatory patterns. This study moves beyond the concern that religious texts and practices may be incompatible with international law, to provide an innovative analysis of how religious actors themselves are accountable under international law for the interpretations they choose to put forward. The book defines religious actors as comprising religious states, international organizations, and non-state entities that assume the role of interpreting religion and so claim a 'special' legitimacy anchored in tradition or charisma. Cutting across the state / non-state divide, this definition allows the full remit of religious bodies to be investigated. It analyses the crucial question of whether religious actors do in fact operate under different international legal norms to non-religious states, international organizations, or companies. To that end, the Holy See-Vatican, the Organization of Islamic Cooperation, and churches and religious organizations under the European Convention on Human Rights regime are examined in detail as case studies. The study ultimately establishes that religious actors cannot be seen to form an autonomous legal category under international law: they do not enjoy special or exclusive rights, nor incur lesser obligations, when compared to their respective non-religious peers. Going forward, it concludes that a process of two-sided legitimation may be at stake: religious actors will need to provide evidence for the legality of their religious interpretations to strengthen their legitimacy, and international law itself may benefit from religious actors fostering its legitimacy in different cultural contexts.
Download or read book Islam and Political Cultural Europe written by W. Cole Durham and published by Routledge. This book was released on 2016-05-06 with total page 318 pages. Book excerpt: Islam and Political-Cultural Europe identifies the sometimes confusing and often contentious new challenges that arise in daily life and institutions as Islam settles deeper into Europe. Exploring the interactions of Muslim, Christian and secular cultures in the context of highly pluralized contemporary European societies, this book offers a valuable tool for those within and outside Europe seeking to understand the far-reaching implications of combining cultures, the struggles of the Muslim-Christian-secular transition, and the progress which the future promises.
Download or read book Secularism s in Contemporary France written by David Koussens and published by Springer Nature. This book was released on 2023-01-01 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: The increasing visibility of Islam in France and the vehemence of debates about it have often contributed to narrow public perceptions of secularism to a simplistic antireligious crusade, a misleading image disseminated by the media and politicians alike. Taking the opposite stand, this book embarks on a comprehensive effort to document the multiple areas in which French secularism plays out - in debates over “cults,” places of worship, chaplaincy services in public institutions, the recognition of associations of worship, and more -, outlining and analizing the legal paths favored by the state in the regulation of religious diversity. While Islam has undoubtedly contributed to the reshaping of French secularism in the last decades, the book moves beyond what has come to be known as the "Muslim Question" to look at the multiplicity of challenges contemporary religious beliefs, practices, and organizations now pose to the state. David Koussens examines the main political and legal configurations of French secularism over the last thirty years through a sociological and juridical lens, in order to better document its diversity. Such a portrait emphasizes that French secularism is not a univocal phenomenon but one that appears in many guises.

Download or read book La nouvelle question religieuse written by Pauline Côté and published by Peter Lang. This book was released on 2006 with total page 402 pages. Available in PDF, EPUB and Kindle. In a context of increasing polarization of public opinion about religious questions, how do issues involving religion appear in France, the United States, Belgium, and Canada? Parliamentary commissions, governmental reports, and laws pertaining to Islam and to so-called sects often lead to the promulgation of regulations that reflect the public's anxiety that religious diversity per se is threatening. The purpose of this book is to examine some of the identities, values, images, and myths that are perceived by decision makers and by participants in civil societies when boundaries are drawn between the public and the religious at the place where globalization and universal human rights meet.
