Creo que esta preferencia se justifica, entre otras razones, en el hecho de que sin actividad interpretativa, es decir, sin el razonamiento necesario para atribuir un significado a una disposición normativa, no habría norma jurídica que aplicar, o razón jurídica que esgrimir en argumentos para criticar los actos de otros o para justificar los propios; no sería posible, dicho en pocas palabras, el razonamiento acerca de cómo se debe actuar con base en el derecho en ciertas ocasiones. Si esto es verdad, la manera de caracterizar la interpretación jurídica tiene una incidencia notable en la representación del razonamiento jurídico: una caracterización (o una representación teórica) (in)adecuada de, por ejemplo, cómo los jueces interpretan disposiciones normativas conlleva una representación (in)adecuada, (im)plausible, tanto de cómo ellas razonan en torno a las normas jurídicas (disposiciones normativas con significado atribuido), como de los argumentos que ellas formulan a favor de aplicar una norma jurídica y, por tanto, de tomar una decisión jurídica (e.g., judicial) específica.

En la primera parte del libro se analiza el concepto de interpretación y aplicación del Derecho, así como las diferentes teorías acerca de la actividad interpretativa. A continuación, se examinan los criterios clásicos de la interpretación del Derecho con la intención de mostrar la amplia libertad de la que gozan los jueces a la hora de su elección. Tal libertad determina en buena medida el contenido de las resoluciones judiciales y permite a los jueces modelar el contenido del Derecho. El último capítulo está dedicado al control de la actividad judicial y a la responsabilidad que tienen los jueces en su actividad cotidiana. Aquí se discuten los problemas relativos a la creación judicial del Derecho, así como la cuestión de hasta dónde puede llegar la denominada discrecionalidad judicial en la aplicación del Derecho. Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship.
