Here the distinguished film scholar Dudley Andrew examines the motivations and consequences of these remarkable films by looking at the cultural web in which they were made. Beyond giving a rich view of the life and worth of cinema in France, Andrew contributes substantially to our knowledge of how films are dealt with in history. Where earlier studies have treated the masterpieces of this era either in themselves or as part of the vision of their creators, and where certain recent scholars have reacted to this by dissolving the masterpieces back into the system of entertainment that made them possible, Andrew stresses the dialogue of culture and cinema. In his view, the films open questions that take us into the culture, while our understanding of the culture gives energy, direction, and consequence to our reading of the films. The book demonstrates the value of this hermeneutic approach for one set of texts and one period, but it should very much interest film theorists and film historians of all sorts.

Au-delà de cette analyse classique, il est plus que jamais utile de vérifier si le droit positif protège les droits de l'homme de façon équivalente. La Convention européenne des droits de l'homme et des libertés fondamentales est, à cet égard, un objet d'étude pertinent dans la mesure où elle valorise certains droits considérés comme indérogeables. Néanmoins, la frontière entre les droits indérogeables et les droits conditionnels n'est pas immuable. Pour important qu'il soit, le critère de la non-dérogeabilité n'est plus le seul à rendre compte de la place d'un droit dans la hiérarchie des droits et libertés. En effet, dès lors que cette distinction n'a de sens qu'en cas de circonstances exceptionnelles, il était tout à fait légitime que le juge détermine une échelle de valeurs valable en temps de paix. Ainsi, la valeur hiérarchique d'un droit se mesurerait également à l'importance que lui donne le juge. Cette étude ne se limite pas à identifier les droits fondamentaux dans l'ordre de valeurs que constitue la Convention et à évaluer les incidences attachées à cette qualification. Elle prétend également rendre compte des insuffisances de la hiérarchie matérielle. Au regard des conflits qui peuvent survenir entre les droits fondamentaux, la question de leur agencement ne pouvait manquer de se poser. Même s'il est difficile de rendre compte de l'appréhension de ces conflits par le juge européen, l'on doit admettre que l'arbitrage auquel il se livre n'exclut pas le recours à une certaine hiérarchisation des intérêts en présence.
