Este sistema fue introducido en el Derecho Español en virtud de la reforma que se hizo del artículo 92 del Código Civil por medio de la Ley 15/2005 de 8 de julio (por la que se modifican el Código Civil y la Ley de Enjuiciamiento Civil en materia de separación y divorcio), precisamente con la finalidad de buscar la continuada implicación de los progenitores en la crianza y formación de sus hijos pese a la existencia de la crisis matrimonial. La intención del legislador con la reforma estaba dirigida a conseguir el ejercicio compartido de la guarda y custodia de los hijos a través de dos supuestos: 1) A solicitud de los cónyuges, bien sea en la propuesta del convenio regulador o en cualquier otro momento del procedimiento judicial que hayan instado (Art. 92.5 CC); 2) Excepcionalmente, a instancia de uno solo de los cónyuges, con informe favorable del Ministerio Fiscal (Art. 92.8 CC). Esta reforma ha sido considerablemente criticada, debido a la regulación superficial y prejuiciosa que se hace de la figura regulada por parte del legislador respecto a la adopción de la misma en sede contenciosa. Es sobre este punto que me centraré en este trabajo, en el que analizaré el contenido del vigente Art. 92 del CC, sus carencias en cuanto a la regulación que hace de la custodia compartida, y la problemática que genera al Juez al momento de decidir qué sistema de guarda es el mejor para los hijos. This report specifically reviews the evidence on the potential mechanisms by which smoking causes diseases and considers whether a mechanism is likely to be operative in the production of human disease by tobacco smoke. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.
