Il n’en est pas de même pour l’employeur fautif. La faute du salarié, à l’origine de la rupture peut être qualifiée de sérieuse, grave ou lourde. En l’absence de définitions légales, la jurisprudence a tenté de tracer les contours des différentes fautes en s’appuyant principalement sur les effets attachés à chacune d’elles. Toutefois, aucune réflexion d’ensemble n’a été menée sur la question de la gradation de ces diverses fautes et leur incidence. Parallèlement, pour des raisons plus idéologiques que scientifiques, le terme de faute de l’employeur apparaît peu usité en droit du travail peut-être parce qu’il s’accorde mal avec l’autorité exercée par ce dernier. Pourtant, les comportements fautifs de l’employeur peuvent être de gravité différente, entrainant des conséquences distinctes et permettant la rupture ou non du contrat de travail. Il n’est pas exclu alors que l’on puisse aussi se diriger vers une gradation des fautes de l’employeur. Par delà les avancées jurisprudentielles, le traitement juridique des fautes demeure cependant inégalitaire. Il en ressort des insuffisances dans les régimes juridiques existants. Des perspectives d’évolution sont envisageables. L’orientation de l’employeur dans la qualification des faits fautifs du salarié devient indispensable et ce, afin d’éviter toute surqualification.
