II DPR 448/88 è, pertanto, strumento primario della Giustizia Minorile: a distanza di un quarto di secolo dalla sua attuazione, alcuni punti sono stati rielaborati per essere in linea con le trasformazioni della società, la persistente adeguatezza della normativa trova la base nei principi educativi e rieducativi che la sostengono.

Book excerpt: Da qualche anno il Dipartimento per la Giustizia Minorile ha avviato una riflessione sul tema della “recidiva”, fenomeno relativo ai rientri nel circuito penale di molti adolescenti, non solo con lo sguardo rivolto al significato giuridico del termine – commissione di un nuovo reato dopo una precedente condanna definitiva – ma anche in termini di monitoraggio dell'intervento operato dalle Istituzioni nei confronti dei minorenni autori di reato. In particolare si è approfondito lo studio della recidiva, campo a tutt'oggi ancora poco esplorato, per individuare le caratteristiche personali del minore, il contesto socio-familiare-etnico e le risposte trattamentali e giudiziarie della Giustizia minorile che vengono messe in atto, anche in termini di politica di prevenzione. Nel corso della presente ricerca si evidenzierà più volte che la recidiva costituisce un buon parametro per la misurazione del successo dell'attività rieducativa ed è proprio questo l'aspetto che più interessa e che ci coinvolge direttamente. Uno degli obiettivi principali dell'intervento penale, ancor più specificamente per i minorenni, è quello di ridurre i rischi di “ricaduta” nel reato; pertanto le Istituzioni, ed in particolare la nostra, devono valutarne il rischio sia sotto il profilo dello studio della personalità del minore, cosí come viene richiesto dal Codice di procedura penale minorile (DPR 448/88), sia sotto l'aspetto dei fattori protettivi del minore che possano aiutare a limitarne il fenomeno. Il termine “recidiva” deriva dal latino “recado” che significa cadere, ricadere... e chi lavora nel nostro ambito sa quanto la probabilità che un adolescente entrato nel circuito penale possa commettere un nuovo reato, appunto “ricadere”, sia in generale elevata. Proprio per questo è prioritario per tutti noi riconoscere le specificità di un'attività rieducativa che sia efficace e mirata a prevenire il fenomeno. La ricerca promossa da questo Dipartimento, che ho il piacere di presentare, “La recidiva nei percorsi penali dei minori autori di reato” è il primo innovativo lavoro che si basa su uno studio longitudinale, svolto a carattere nazionale, in cui il minore viene “monitorato” in tutto il suo percorso penale, seguito dal primo momento della presa in carico dall'Ufficio di Servizio Sociale per i Minorenni sino all'ultima fase, in alcuni casi sconfinante, purtroppo, nella prosecuzione del percorso deviante anche da adulto. Nel piano della ricerca è inclusa, inoltre, una prima misurazione dei costi relativi agli interventi attuati nei confronti dei minorenni, in particolare della “messa alla prova” (art. 28-DPR 448/88). Ciò al fine di poter formulare una valutazione sull'economicità e l'efficacia delle azioni rieducative intraprese. Per concludere, voglio ringraziare tutti coloro che hanno contribuito alla realizzazione della ricerca, addentrandosi in un campo ancora poco esplorato scientificamente: gli operatori tutti della Giustizia Minorile e dell'Università di Perugia. Un ringraziamento particolare è rivolto agli Uffici di Servizio Sociale per i Minorenni che si sono fatti carico del delicato lavoro d'individuazione e ricostruzione dei fascicoli dei minori attraverso i quali è stato possibile seguire il tracciato del loro percorso penale.
