Nella prima parte, è inquadrato il contesto normativo ambientale nazionale e comunitario entro il quale si svolge l’esercizio delle attività sanitarie, con le conseguenti indicazioni gestionali. Sono quindi proposte agli operatori delle linee guida tecniche, ragionate e supportate da ampi riferimenti normativi. Book excerpt: In un sistema giuridico caratterizzato da un’inflazione normativa e da una stratificazione di disposizioni in materia ambientale, spesso di complessa lettura ed interpretazione, il presente volume nasce dall’esigenza di fornire alla pluralità di soggetti che, a vario titolo, risultano coinvolti nel settore dei cantieri temporanei, una ricostruzione completa ed esaustiva degli adempimenti normativi applicabili nella gestione dei rifiuti di cantiere. Vuole pertanto rappresentare un valido supporto giuridico ai numerosi operatori chiamati ad una gestione ambientale del cantiere, attraverso la conoscenza delle specifiche prescrizioni di legge connesse alle attività da eseguirsi, finalizzata alla minimizzazione degli impatti ambientali e dei rischi sanzionatori e ad assicurare una corretta e coordinata esecuzione dei lavori, permettendo il raggiungimento degli obiettivi contrattualmente definiti nel rispetto degli obblighi di legge. Il testo risulta aggiornato al D.Lgs. 3 aprile 2006, n. 152, “Norme in materia ambientale”, e sue successive modifiche ed integrazioni e alla normativa riguardante l’istituzione del sistema di controllo della tracciabilità dei rifiuti (cd. Sistri) di cui al D.M. 18 febbraio 2011, n. 52, definito come il nuovo “Testo Unico Sistri”, come modificato dal D.M. 10 novembre 2011, n. 219. Il testo risulta pure aggiornato alla legge 24 febbraio 2012, n. 14, di “Conversione in legge, con modificazioni, del decreto-legge 29 dicembre 2011, n. 216”, recante proroga dei termini di entrata in operatività del sistema di tracciabilità dei rifiuti, ed è altresì aggiornato al D.Lgs. 7 luglio 2011, n. 121, “Attuazione della direttiva 2008/99/CE sulla tutela penale dell’ambiente”, che ha provveduto ad inserire alcuni reati ambientali tra gli “illeciti presupposto” idonei per attivare la responsabilità amministrativa delle società ai sensi del decreto legislativo 8 giugno 2001, n. 231. Il volume analizza, dal punto di vista normativo, le seguenti principali tematiche connesse alla gestione dei rifiuti nelle attività di cantiere: - la gestione dei rifiuti da costruzione e demolizione; - la gestione dei rifiuti da attività di manutenzione; - il produttore dei rifiuti ed il regime di responsabilità; - gli oneri e gli adempimenti del produttore dei rifiuti; - la gestione di impianti fissi e mobili di recupero di rifiuti in procedura ordinaria e semplificata; - la disciplina del conferimento dei rifiuti in discarica ed in impianti di trattamento con procedure semplificate; - la disciplina del trasporto di rifiuti in conto proprio ed in conto terzi; - il sistema di controllo della tracciabilità dei rifiuti (Sistri); - le istruzioni per la compilazione del registro di carico e scarico e delle schede Sistri; - la gestione dei rifiuti da attività di costruzione e demolizione e la particolare gestione dei rifiuti prodotti in cantiere nel sistema di controllo della tracciabilità dei rifiuti (Sistri); - la gestione dei “sottoprodotti”; - le sanzioni applicabili.
