Book excerpt: En los estudios introductorios de Derecho Romano es frecuente que se plantee una separación entre los aspectos históricos e institucionales, presentados en tratamientos independientes. Asimismo, resulta también habitual que no se preste una atención específica a los primeros momentos de la historia del ordenamiento jurídico romano. No obstante, lo que podemos saber sobre esa época genética o primordial ha de ser considerado de extrema importancia para comprender todo el desarrollo histórico-jurídico posterior. Por otra parte, sin distinguir entre lo que cabe denominar Derecho Romano primitivo y Derecho Romano arcaico se hace muy difícil plantear un cuadro suficiente de los primeros desarrollos de esta génesis de un ordenamiento tan alejado en el tiempo. En la obra se plantea precisamente una reflexión acerca de esta materia poniendo como eje el momento de la fundación de la Ciudad a mediados del siglo VIII a.C. y presentando una síntesis del contexto histórico -prehistórico- en el que se produce la constitución de la Urbe como forma estatal, a partir del grupo étnico de los latinos de la Italia central, una sociedad basada en la mutua e igualitaria vinculación de grupos extensos de parentesco. A este análisis histórico se acompaña una interpretación de las categorías fundamentales de la antropología jurídica romana describiendo las líneas de evolución que llevan hasta la original creación del concepto de persona. Pensamos que las reflexiones contenidas en este libro pueden contribuir a una mejor compresión de los principios esenciales que sirvieron de presupuesto a la experiencia jurídica en Roma.
