Book excerpt: Le marché immobilier marocain n'est pas uniquement animé par les investisseurs nationaux, bien au contraire, les investisseurs non-résidents, qu'il s'agisse de marocains expatriés ou d'étrangers, institutionnels ou particuliers, participent dans une grande mesure à la dynamisation de ce secteur qui représentait en 2009, 22% des investissements directs étrangers au Maroc. La fiscalité applicable aux revenus et profits obtenus par ces non-résidents, devait par conséquent être étudiée, non seulement à la lumière du droit interne applicable au Maroc, mais également à la lumière des conventions fiscales internationales de non-double imposition signées par le Maroc avec ses différents partenaires. La présente étude prétend aborder la question de l’imposition des revenus locatifs et des plus-values de cession de biens ou de titres représentatifs de ces biens, réalisés sur le sol marocain, par des investisseurs immobiliers non-résidents. On serait tentés à ce titre, de penser qu’il existe au Maroc une fiscalité spécifique réservée aux étrangers, particuliers ou entreprises, or ceci n’est pas le cas, sauf rares exceptions. Afin d’appréhender les spécificités de cette fiscalité bien particulière, il faut se situer au confluent de la fiscalité applicable aux investisseur immobiliers locaux, et de la fiscalité internationale générale. Or au moment ou la bataille fait rage pour attirer les délocalisations et les implantations d’entités étrangères, la nécessité de concevoir et mettre en place un système fiscal compétitif et attractif particulier aux entités non-résidentes, se pose avec.
