Book excerpt: Un quart de siècle après sa naissance, la Communauté européenne progresse moins rapidement dans le développement de sa dimension sociale que dans sa dimension économique. Le milieu des années 1980 a cependant marqué une rupture : sous l’impulsion de la nouvelle Commission, la construction de l’Europe sociale est progressivement devenue prioritaire. Dans des domaines aussi divers que la liberté de circulation des travailleurs et des citoyens, l’égalisation des chances entre hommes et femmes, les actions en faveur de l’emploi, du dialogue social, de la protection des travailleurs et des consommateurs, de la mise en place d’un espace éducatif européen, etc., les avancées ont été des plus importantes depuis 1985 et se poursuivent désormais à un rythme soutenu. D’ici la fin du siècle, la liste des chantiers de construction de l’Europe sociale que l’on se propose de poursuivre ou de lancer est très impressionnante, marquant une nette volonté de prôner désormais un mode de développement plus équilibré. Reste à savoir si ces déclarations d’intention seront entièrement suivies d’effets. La question mérite d’autant plus d’être posée qu’elle fait officiellement l’objet d’un débat au sein des diverses instances communautaires.

La politique sociale structurelle et la législation sociale liée à la mobilité des personnes sont aujourd'hui très structurées, mais encore faut-il désormais, et c'est l'un des enjeux de la Charte communautaire des droits sociaux fondamentaux des travailleurs et du traité sur l'Union européenne, développer, dans le respect du principe de subsidiarité, une politique sociale indépendante de la mobilité. C'est ce troisième pilier, dont la construction démarre vraiment aujourd'hui, qui permet de conclure à l'affirmation d'une politique sociale structurée. Ce passage d'un catalogue de droits sociaux à une politique organisée est l'enjeu fondamental pour la réussite du projet de citoyenneté transnationale conçu comme un objectif à terme par les pères fondateurs de la construction européenne.

C'est l'objet de cette recherche. La première partie rappelle l'inscription des systèmes sociaux dans les héritages nationaux. Les fondements théoriques de la diversité des systèmes sont présentés. L'accent est ensuite mis sur les différences institutionnelles qui les traversent. La seconde partie traite de la dynamique des systèmes sociaux. Il est fait état de l'existence d'un mouvement de convergence plus abouti sur les marchés du travail qu'en matière de protection sociale. La hiérarchisation des avancées institutionnelles communautaires peut l'expliquer. Une tendance à l'hybridation libérale des systèmes est également soulignée. Le risque de convergence vers le bas qui l'accompagne conduit alors à mettre en perspective les conditions d'un approfondissement légitime de la dimension sociale de la construction européenne.
