Book excerpt: Como es sabido, en los últimos años, tanto en España como en otros muchos países de nuestro entorno cultural, se ha ido imponiendo, de manera cada vez más evidente, un modelo político-criminal basado en la seguridad; un modelo, dicho más concretamente, en el que la libertad individual y los principios y garantías tradicionalmente destinados a limitar el ius puniendi estatal han ido cediendo terreno ante la creciente preocupación por la seguridad –o por una particular forma de seguridad–. Este modelo ha dado lugar a una serie de modificaciones legislativas en las que puede apreciarse cierta tendencia a utilizar la sanción penal más como una forma de evitar conductas peligrosas o de inocuizar a quienes pueden ser considerados sujetos peligros, que por castigar de manera justa la comisión de un hecho delictivo. Entre las numerosas manifestaciones de esta nueva orientación político-criminal se encuentran precisamente algunas nuevas figuras delictivas que sancionan determinadas conductas por el peligro que a partir de ellas se le presume al autor de las mismas, y no tanto por la amenaza que el hecho realizado representa realmente para los intereses o bienes jurídicos que se desea proteger. Hasta el punto de que, en ocasiones, da la impresión de que, directamente, la sanción penal no se impone por el hecho cometido, sino por el hecho que se puede llegar a cometer, lo que supone la vulneración de uno de los principios más importantes del Derecho penal de un Estado social y democrático de Derecho: el llamado “principio del hecho”.

Book excerpt: La presente obra constituye el resultado final del proyecto de investigación “Responsabilidad penal por el hecho y Estado democrático. Una investigación sobre la legitimidad de la criminalización de ideas y caracteres” (FACTUM, RTI2018-097727-B-I00), financiado desde el Programa Estatal de Investigación, Desarrollo e Innovación orientada a los Retos de la Sociedad del Ministerio de Ciencia e Innovación. Su objeto, el principio de responsabilidad por el hecho, se erige, sin duda, en uno de los límites de la intervención penal de un Estado democrático de mayor relevancia. El proceso de inexorable deconstrucción que este principio viene sufriendo en la actualidad, obliga a indagar en las causas de esta crisis y a reflexionar sobre sus eventuales vías de solución. El grave retroceso que están sufriendo las garantías constitucionales propias de un Estado social y democrático de Derecho también está afectando, como no podría ser de otro modo, al principio de culpabilidad. Con la entrada en vigor de la Constitución se alberga la fundada esperanza de que el Derecho Penal se correspondiera, después de la dictadura, con el de un Estado verdaderamente democrático. Quizá por ello, el modo en que este derrumbamiento se está produciendo resulta particularmente desilusionante: mientras que la consolidación de esas garantías ha representado un proceso lento y difícil, por desgracia su desintegración parece haber transcurrido de un modo mucho más rápido y sencillo. En los diferentes capítulos del libro, los integrantes del proyecto analizan aquellos aspectos de la responsabilidad por el hecho que actualmente resultan afectados, en mayor medida, por las múltiples reformas legislativas, especialmente por las operadas en la última década y, en algunos supuestos, también por su aplicación en los tribunales e incluso por determinadas teorías doctrinales. Ojalá que algunas de las alternativas aquí insinuadas, sirvan para mostrar a la política criminal el camino que nunca debió haber abandonado: el del innegociable respeto de las garantías constitucionales. Book excerpt: In consequence of an increased interest in problems relating to human action, normative concepts have been much discussed by philosophers and logicians in the past twenty years. Deontic logic, which deals with the normative use of language and such normative concepts as obligation, prohibition and permission, has become one of the most intensively cultivated areas of formal logic. Important investigations have been carried out which have shed considerable light on various aspects of the normative phenomenon and a great number of different systems of deontic logic have been developed. This progressive proliferation of deontic logics not only shows the great interest of logicians in normative discourse, but also reflects a basic perplexity: the lack of suitable criteria of adequacy for the interpretation of deontic calculi and hence difficulty in decid ing which of the systems provides the best reconstruction of the underlying normative concepts and can therefore be applied with the most fruitful results. This difficulty is so great that some authors have even expressed doubts about the practical usefulness of deontic logic. One of the sources of this perplexity lies in the absence of a well established pre-analytical basis for formal studies. It is sometimes even uncertain what the intuitive notions are that deontic logicians intend to reconstruct. In talking about obligations, prohibitions and permissions, they usually have in mind moral norms. But the choice of moral norm as an explicandum for the construction of a logic of norms has several disadvantages.
