The author argues that although the use of IPRs to safeguard ICH presents challenges and has impeded sustainable development in some cases, the adoption of these rights on ICH also presents opportunities and, fundamentally, is not contrary to the spirit of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (UNESCO 2003 Convention). The adoption of IPRs on ICH can form an important part of the development of sustainable safeguarding plans capable of benefitting the communities, groups and individuals (CGIs) that create, maintain and transmit such heritage. The book provides a nuanced analysis of the relationship between intellectual property (IP) law and ICH as well as examining the role of IPRs in safeguarding ICH through the lens of sustainable development. It analyses the relationship between IP law and ICH from environmental, social and economic perspectives. These perspectives allow a thorough evaluation of both the positive effects and potential pitfalls of adopting IPRs to safeguard ICH. The book addresses deeper structural matters that refer back to the safeguarding of social and environmental processes underlying ICH.

However, that simple affirmation assumes agreement about definitions of the "human" as well as what a human is entitled to under law, bringing us quickly to concepts such as freedom, property, and the inalienability of both. The assumption that we all mean the same things by these terms carries much political import, especially given that different communities (national, ethnic, religious, gendered) enact some of the most basic categories of human experience (self, home, freedom, sovereignty) differently. But whereas legal definitions often seek to eliminate ambiguity in order to define and protect the rights of humanity, ambiguity is in fact inherently human, especially in performances of heritage where the rights to sense, to imagine, and to claim cultural identities that resist circumscription are at play. Cultural Heritage in Transit examines the intangibilities of human rights in the realm of heritage production, focusing not only on the ephemeral culture of those who perform it but also on the ambiguities present in the idea of cultural property in general—who claims it? who may use it? who should not but does? In this volume, folklorists, ethnologists, and anthropologists analyze the practice and performance of culture in particular contexts—including Roma wedding music, Trinidadian wining, Moroccan verbal art, and Neopagan rituals—in order to draw apart the social, political, and aesthetic materialities of heritage production, including inequities and hierarchies that did not exist before. The authors collectively craft theoretical frameworks to make sense of the ways the rights of nations interact with the rights of individuals and communities when the public value of artistic creations is constituted through international law. Book excerpt: The philosopher Christopher Small suggests that musical meanings are concerned with relationships, both with other human beings and with the world, and that music functions as a means of exploration, affirmation, and celebration of those relationships. If members of different social groups have different values, or different concepts of ideal relationships, then the kinds of performances that enact those relationships will differ from one another. Using music to express benevolent intentions is not, in general, one of its most obvious functions. In fact, military music has been used throughout history to destroy cross-cultural communion. Music is also a powerful and ubiquitous tool in propaganda, and in facilitating various political projects in all kinds of inventive ways that have nothing much to do with the pursuit of peaceful and cooperative intercultural understanding, or with helping people address issues of injustice. This text moves far beyond the knowledge of music's power upon humans, however this may be conceived and explained. It addresses a field of inquiry that is still a tiny endeavor, at least in comparison with all other academic efforts in the world. The sparseness of serious theoretical engagement with the topic of music's potential role in the area of peace and policy is echoed by how little music is directly used in the "real world" for building a more humane consciousness. Finding ways to that goal is the purpose of this work.

Unless policy makers redefine human rights and reformulate environmental law and policies to protect the preconditions for life itself -- water, food, clean air, and biodiversity -- humankind faces the complete loss of the ecological commons, the preservation of which is one of our most basic human rights. A new kind of cosmopolitanism, one centred on the United Nations, offers the best hope for preserving our common heritage and the survival of future generations.
