Download or read book The Strategic Constitution written by Irvin Studin and published by UBC Press. This book was released on 2014-05-15 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: Historically, Canada’s Constitution has been principally viewed as a federal framework or a rights bulwark. This book offers a brand new interpretation. The “Strategic Constitution,” as proposed by Irvin Studin, can be a framework for Canada to project strategic power in the world. This framework lays the foundations for a new school of Canadian constitutional scholarship. Studin begins by reducing the Constitution to its strategically relevant essentials or building blocks. He then provides a wide-ranging audit of the Constitution in terms of its implications for so-called factors of strategic power: the military, diplomacy, executive potency, natural resources, the economy, strategic communications, and the national population. He later applies the Strategic Constitution framework to four policy case studies: Canadian regional leadership in the Americas; bona fide war (as in Afghanistan); Arctic sovereignty; and counterterrorism. Provocative and well-argued, this book makes the case for the Constitution being a highly flexible national framework that quietly harbours seeds of national strategic potency.

Book Indigenous Legal Traditions

    Book Details:
  • Author : Law Commission of Canada
  • Publisher : UBC Press
  • Release : 2008-01-01
  • ISBN : 077484373X
  • Pages : 189 pages

Download or read book Indigenous Legal Traditions written by Law Commission of Canada and published by UBC Press. This book was released on 2008-01-01 with total page 189 pages. Available in PDF, EPUB and Kindle. Book excerpt: The essays in this book present important perspectives on the role of Indigenous legal traditions in reclaiming and preserving the autonomy of Aboriginal communities and in reconciling the relationship between these communities and Canadian governments. Although Indigenous peoples had their own systems of law based on their social, political, and spiritual traditions, under colonialism their legal systems have often been ignored or overruled by non-Indigenous laws. Today, however, these legal traditions are being reinvigorated and recognized as vital for the preservation of the political autonomy of Aboriginal nations and the development of healthy communities.

Book Revisiting Moroccan Migrations

Download or read book Revisiting Moroccan Migrations written by Mohammed Berriane and published by Routledge. This book was released on 2018-02-02 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the 20th century, Morocco has become one of the world’s major emigration countries. But since 2000, growing immigration and settlement of migrants from sub-Saharan Africa, the Middle East, and Europe confronts Morocco with an entirely new set of social, cultural, political and legal issues. This book explores how continued emigration and increasing immigration is transforming contemporary Moroccan society, with a particular emphasis on the way the Moroccan state is dealing with shifting migratory realities. The authors of this collective volume embark on a dialogue between theory and empirical research, showcasing how contemporary migration theories help understanding recent trends in Moroccan migration, and, vice-versa, how the specific Moroccan case enriches migration theory. This perspective helps to overcome the still predominant Western-centric research view that artificially divide the world into ‘receiving’ and ‘sending’ countries and largely disregards the dynamics of and experiences with migration in countries in the Global South. This book was previously published as a special issue of The Journal of North African Studies.

Book Fragmentation and the International Relations of Micro states

Download or read book Fragmentation and the International Relations of Micro states written by Jorri Duursma and published by Cambridge University Press. This book was released on 1996-10-31 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: At a time when nearly all armed conflicts are related to self-determination, and frequently to claims for secession, this meticulous study examines the legal issues at stake in the light of the existence of European micro-States: Liechtenstein, San Marino, Monaco, Andorra and the Vatican City. Jorri Duursma makes a thorough analysis of the true origins, meaning and faults of the modern right of self-determination, asking fundamental questions: What constitutes a people with a right to self-determination? How small a people has this right? Who are allowed to secede? What is a state according to international law? Jorri Duursma's book provides an up-to-date and informed account of these important issues which also draws on recent experiences in Eastern Europe and Yugoslavia. It is the first book to provide a thorough international legal account of the European micro-states, and develops a novel approach to the problems of fragmentation.

Book Beyond the Nass Valley

Download or read book Beyond the Nass Valley written by Owen Lippert and published by The Fraser Institute. This book was released on 2000 with total page 16 pages. Available in PDF, EPUB and Kindle. Book excerpt: On December 11th 1997, then Chief Justice Antonio Lamer of the Supreme Court of Canada radically rewrote how the law requires the resolution of Aboriginal land claims. His decision in the long-running case, Delgamuukw vs. British Columbia, expanded the substance of Aboriginal title and created new ways to determine its presence, including oral testimony. Though the case originated in British Columbia, it has the potential to influence all regions of Canada. In July 1998 and April 1999, the Fraser Institute held conferences to explore the national implications of the decisions. Thirty top law professors, economists, and researchers contributed papers now brought together in this volume, bringing together the Native and non-Native perspectives on the topic.
